Resolution declared adopted. <br />CUP FOR Mayor Fahey opened the Public 1-tearing to reconsider the application <br />GARAGE - for Conditional Use Permit to construct a 36 foot by 28 foot accessory <br />3058 garage at 3058 Greenbrier Street as requested by AI and Cindy Mentes. <br />GREENBRIER- Fahey noted that the Planning Commission reconsidered this request <br />MEN'TES and have recommended approval of the Conditional Use Permit. <br />Cindy Mentes appeared before the Council and reported that they would like a <br />Conditional Use Permit to consu'uct a 1,008 square foot detached garage. <br />Including their existing attached garage, this would bring their total garage <br />space up to 1,448 square feet. Mentes reported that since the last consideration <br />of this request they have lowered the height Prom 12 feet to 9 feet and have <br />changed the location of the detached garage. In discussing location with their <br />neighbor, Mr. Otto, they decided that the new garage would be approximately <br />12 feet from their shared property line and 30 feet from the back of their <br />existing garage even with their deck. A little over I 1 feet of the new garage <br />would be behind the existing garage, thus minimizing visibility from the street. <br />Jon Erik Kingstad, attorney representing Mr. and Mrs. Mentes, submitted a <br />letter to the Council in which he challenges the City Planner's report relative to <br />the CUP application as well as challenges the City sta1~'s authority to retain the <br />consultant at the expense of Mr. and Mrs. Mentes without their consent. <br />Fahey pointed out that the City Council was just presented this report this <br />evening, and suggested that it be referred to the City Attorney for his opinion. <br />As a result, Fahey suggested that consideration of the CUP be tabled to give <br />the City Attorney an opportunity to prepare an opinion. <br />Cindy Mentes reported that at the Planning Commission meeting a couple of <br />neighbors appeared to find out more information relative to the CUP <br />application. "these property owners did not voice opposition to the proposed <br />garage. AI Mentes indicated that he adjusted the proposed placement of the <br />garage working with his neighbor, Mr, Otto. He also noted that he has lowered <br />the height of the garage. <br />s <br />
