<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: July 21, 2017 <br /> <br />RE: Workshop Liquor Licensing Revisions and Special Conditions for Hoggsbreath <br /> <br /> <br />At our workshop this Wednesday, the Council will discuss the above topic with the assistance of <br />the City Attorney’s Office and Commander Rich Clark of the Ramsey County Sheriff’s <br />Department. The City Attorney is preparing some ordinance revisions for your consideration. <br />They will be forwarded under separate cover early next week. The intent of these provisions is <br />that they would be in play for all liquor establishments. <br /> <br />In a memo from the City Attorney’s office, they were talking about language as noted below: <br />Restrictions on Liquor Licenses <br />When a reasonable basis is found by the Council, the Council may impose <br />conditions and restrictions on a liquor license issued under this Chapter in order <br />to preserve the public peace and protect and promote good order and safety. The <br />reasonable conditions or restriction may include, but are not limited to, the <br />following: <br />(1) A limitation as to the hours when intoxicating liquor may be sold and/or <br />consumed on licensed premises. <br />(2) Security requirements to ensure that nuisances or any illegal activity will <br />be prevented. <br />(3) Establishment of a dress code for certain hours of operation of the <br />business. <br />(4) Any other condition that the Council finds will help preserve the public <br />peace and promote good order and safety. <br />Any violation of these reasonable conditions or restrictions may lead to the <br />revoking of the liquor license. <br />In the case of the Hoggsbreath, staff believes special provisions are warranted as conditions of <br />the liquor license for that establishment. To enact those, an agreement would need to be reached <br />with Mr. Duray. If that did not occur, we would need to ensure due process considerations are <br />addressed. <br /> <br />
