STAFF REPORT TO: Mayor Keis and Members of City Council FROM: Joel Hanson, City Administrator DATE: July 21, 2017 RE: Workshop Liquor Licensing Revisions and Special Conditions for Hoggsbreath At our workshop this Wednesday, the Council will discuss the above topic with the assistance of the City Attorney’s Office and Commander Rich Clark of the Ramsey County Sheriff’s Department. The City Attorney is preparing some ordinance revisions for your consideration. They will be forwarded under separate cover early next week. The intent of these provisions is that they would be in play for all liquor establishments. In a memo from the City Attorney’s office, they were talking about language as noted below: Restrictions on Liquor Licenses When a reasonable basis is found by the Council, the Council may impose conditions and restrictions on a liquor license issued under this Chapter in order to preserve the public peace and protect and promote good order and safety. The reasonable conditions or restriction may include, but are not limited to, the following: (1) A limitation as to the hours when intoxicating liquor may be sold and/or consumed on licensed premises. (2) Security requirements to ensure that nuisances or any illegal activity will be prevented. (3) Establishment of a dress code for certain hours of operation of the business. (4) Any other condition that the Council finds will help preserve the public peace and promote good order and safety. Any violation of these reasonable conditions or restrictions may lead to the revoking of the liquor license. In the case of the Hoggsbreath, staff believes special provisions are warranted as conditions of the liquor license for that establishment. To enact those, an agreement would need to be reached with Mr. Duray. If that did not occur, we would need to ensure due process considerations are addressed.
