MINUTES <br />CITY COUNCIL <br />MARCH 27, 2002 <br />GREENBRIER of the CUP subject to conditions as outlined in the minutes of their February <br />STREET 14, 2002 meeting. <br />There was no one present from the general public wishing to comment on this <br />matter. <br />Cindy Mentes appeared before the Council and asked that the Council follow <br />the recommendation of the Planning Commission and approve the CUP. <br />Scalze noted the listing of garages within Little Canada that Mr. and Mrs. <br />Mentes put together. She noted that on that listing only three garages exceeded <br />the 1,000 square feet the triggers the CUP requirement, and based on some <br />quick research it appears that these garages predate the 1980 ordinance <br />requirement. Scalze noted that the majority of the garages that the Mentes list <br />are detached garages, under 1,000 square feet, and in compliance with the <br />City's ordinance requirements. <br />Fahey reported that he looked at the area and he is not aware, nor did he <br />observe any property with two large garages. He did note that he observed <br />quite a few small storage sheds. Fahey pointed out that the issue as it relates to <br />the Mentes' request is the character of the neighborhood. He noted that the <br />Mentes' back yard area is very open to the east. A large garage sitting in that <br />back yard will have a significant impact on the area. Fahey noted that the <br />Council has to look at the broader perspective and detern~ine whether this <br />request makes sense for the area. Fahey pointed out that the Council must <br />consider what this neighborhood would look like if every property owner built <br />a second large garage on their properties. <br />Al Mentes commented on other large garages in his neighborhood. Fahey <br />stated that he drove down the street several times and he did not see any <br />properties with two large garages. <br />Cindy Mentes pointed out the Planning Commission's recommendation and <br />asked that the Council follow that recommendation. <br />Scalze noted that the Planning Commission is a recommending body to the <br />City Council and it is the Council that makes the decision. <br />Al Mentes indicated that his concern is with the preparation work that they did <br />prior to purchasing the property. Mentes indicated that he and his wife, as well <br />as their realtor, checked with the City about the ability to construct a second <br />garage on this property. Mentes claimed they were told a CUP would be <br />necessary, but would likely be approved. Mentes stated that if they had known <br />they would not be able to get a CUP, they would not have purchased the <br />property. <br />2 <br />
