MINUTES <br />CITY COUNCIL <br />MARCH 27, 2002 <br />Kingstad stated that the Council may have had this subjective intent, however, <br />this is not what the ordinance says. <br />Fahey stated that he did not believe the garage as proposed was compatible <br />with the neighborhood from an architectural and scale standpoint. <br />The City Attorney pointed out Section 921.030 of the Code indicates that in <br />considering CUP requests, the Council may consider the nature of adjoining <br />land. <br />Upon motion by Fahey, seconded by Scalze, the public hearing was closed. <br />Al Mentes noted some of the garage sizes of neighboring properties. Montour <br />pointed out that these properties only have one garage, while Mentes is <br />requesting a second garage. Scalze also noted that garages that are 1,000 <br />square feet or less are allowable under the Code without the additional <br />requirement of a CUP. <br />Anderson pointed out the previous approval of the Council in support of a <br />CUP provided that the garage proposed is downsized and moved to within 6 <br />feet behind the existing garage. <br />Al Mentes noted that he would have to cut off a portion of his deck to locate <br />the garage as the Council indicated. Mentes again expressed concern with the <br />preplanning that they did prior to purchasing the house. Mentes felt that <br />without the garage they are requesting, they will have to sell their property and <br />move. He noted that the possessions they would like to house in the proposed <br />garage are in storage. He also noted that he does not work on cars and the <br />proposed garage is not being proposed for that use. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-3-64 -DENYING THE RECONSIDERATION <br />OF THE CONDITIONAL USE PERMIT AS REQUESTED BYAL AND <br />CINDYMENTES FOR 3058 GREENBRIER STREET BASED ON THE <br />ORDINANCE AS INTERPRETED BY THE CITY PLANNER AND THE <br />CITYATTORNEY, BASED ON THE FACT THAT THE 36 FOOT BY 28 <br />FOOT ACCESSORY GARAGE WOULD BE OUT OF PROPORTION AND <br />SCALE WITH THE NEIGHBORHOOD AND WOULD NOT BE <br />COMPATIBLE WITH THE NEIGHBORHOOD, NOTING THAT THE <br />CIRCUMSTANCES HAVE NOT CHANGED SINCE THE COUNCIL'S <br />PREVIOUS ACTION ON THE CONDITIONAL USE PERMIT REQUEST <br />AND NOTING THAT THE PREVIOUS ACTION WOULD ALLOW THE <br />MENTES' CONSIDERABLE USE OF THEIR PROPERTY WITH THE <br />
