<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: August 7, 2017 <br /> <br />RE: TNT Billiard Hall, 80 Little Canada Road E. – Conditional Use Permit for Commercial <br /> Recreational Use with Alcohol Sales <br /> <br />The applicant, Nathan Badger, Owner of TNT Billiards is requesting a Conditional Use Permit to allow for a <br />commercial recreation use that serves alcoholic beverages in conjunction with a pool hall. <br /> <br />The pool hall is located at 80 Little Canada Road E. in the northwest corner <br />of Tim Smith’s building. The subject property is zoned PUD, Planned Unit <br />Development. The uses allowed on this property as part of the existing PUD <br />Permit are those uses as outlined in the B-3, General Business District. <br />In the B-3 District, Amusement places (without alcohol sales) are a permitted <br />use subject to city licensing (which the applicant has obtained) and TNT <br />Billiard Hall has been in operation at this location for a couple of months. <br />The billiard hall is requesting to add alcohol service as part of their offerings <br />to customers and this expanded use triggers the need to amend the PUD <br />Permit as the B-3 District regulates commercial recreations uses with <br />alcohol by Conditional Use Permit. <br /> <br />The subject parcel is zoned: PUD, Planned Unit Development. The property <br />is surrounded primarily by properties also zoned PUD. It should be noted <br />that the properties on the west side of Jackson Street to the south of this <br />parcel are legal non-conforming Single-Family Residential uses. In addition, <br />the parcel directly to the west (slight sliver of yellow in image above) is <br />zoned R-1, Single Family Residential. <br /> <br />Analysis <br />As mentioned above, TNT Billiards has only been in operation for a few months within the City. Both the Fire <br />Marshal and Building Official have inspected the suite to ensure compliance with applicable codes. In addition to <br />the billiard hall use, TNT Billiards also has a retail area and repair shop within their suite. The hours of operation <br />for the retail and repair shop portion of the business are Monday – Saturday from 11 a.m. to 6 p.m. Pool table play <br />is also open during these same hours, but remains open until 1 a.m. and occasionally on Sundays for events or <br />league play. There are two entrances to TNT Billiards. The primary entrance along Little Canada Road that brings <br />customers into the retail and repair shop area is a shared entryway with another tenant in the building. This shared <br />entrance is closed at 6 p.m. The other entrance for TNT Billiards is on west side of the building. This doorway <br />brings customers directly into the billiard hall space and is the only entrance open from 6 p.m. to 1 a.m. for billiard <br />hall customers. <br /> <br />TNT Billiards currently leases 3,500 square feet of space within this multi-tenant property which is a combination <br />of retail store, repair shop, and billiard hall. They currently have eight pool tables available for customers. The <br />applicant has indicated that they have signed an agreement with Mr. Smith to add an additional 1,600 square feet to <br /> <br />
