<br />their unit by September 1st. The additional space is currently used for warehouse by another tenant, but will be <br />converted to billiard hall space. By doing this, TNT Billiards plans to have a total of 12 tables by September 1st. <br /> <br />According to Section 912.040.G, pool halls serving alcoholic beverages are allowed by Conditional Use provided <br />compliance with several conditions. The specific code language is copied below with staff comments in italics - <br /> <br />G. Commercial Recreation. Those establishments serving alcoholic beverages in conjunction with <br />pool hall, bingo, golf, indoor firearms/archery ranges, and amusement centers as a principal use, <br />provided that: <br /> <br />1. If located within a shopping center, the use has its own exclusive exterior access. <br /> <br />TNT Billiards has two entrances within the building. The entrance to the retail area is a <br />shared entryway with another tenant, but this doorway is locked at 6 p.m. The second <br />entrance for the billiard hall is on the west side of the building and it is exclusive to TNT <br />Billiards. This will be the primary entryway for customers looking to play pool. <br /> <br />2. Any and all applicable local, state and federal laws, permits licenses and operational <br />regulations are complied with. <br /> <br /> TNT Billiards currently has an Amusement license issued by the City for the pool tables. <br />Furthermore, the Fire Marshal and Building Official inspected the space prior to the <br />business opening earlier this year. The City Clerk has been working with TNT Billiards on <br />the necessary requirements and licensing needed for beer/alcohol sales. <br /> <br />3. The use is located and developed so as not to create an incompatible operation problem <br />with adjoining and neighboring commercial and/or residential uses. <br /> <br /> One of the factors that staff continues to review with this multi-tenant location is whether <br />or not ample parking is available for the site as a whole. A tenant that had previously <br />occupied the southeast corner of the building has since vacated the property. This tenant <br />had a number of employees and equipment (e.g. trucks, trailers, outdoor storage) that <br />tended to overburden the site day, plus items were left overnight in the required parking <br />spaces. <br /> <br />TNT Billiards is open at 11:00 a.m., but this will be primarily for customers seeking the <br />retail or repair shop portion of the business. The customer base using the pool tables for <br />events or league play will typically arrive in the evening hours after 6 p.m. or on the <br />weekends. This is a plus staff believes in consideration of whether or not there is sufficient <br />parking. The Property Owner has indicated that the other tenants of the building are <br />closed by 6 p.m. and not open on the weekends. With no other building tenant needing <br />evening parking this allows for the billiard hall to utilize all 70 parking spaces on the <br />property. During the day, the Property Owner has allotted 20 parking spaces to TNT <br />Billiards. For the retail and repair portion of the business, staff believes this should be <br />sufficient parking during the day. <br /> <br />4. The hours of operation shall be subject to City Council control and change as a means to <br />maintain compatibility of uses and activities. <br /> <br /> Hours of operations are: <br />• Retail & Repair – Monday through Saturday 11:00 a.m. to 6:00 p.m. <br />• Billiard Hall – Monday through Saturday 11:00 a.m. to 1:00 a.m. and <br />occasionally on Sunday for special events or leagues. <br />
