STAFF REPORT <br />TO: Planning Commission Members <br />FROM: Jessica Jagoe, Associate Planner <br />DATE: August 17, 2017 <br />RE: 3100 Country Drive – PUD Amendment <br />Following the discussion from the Planning Commission meeting, city staff arranged a meeting with <br />Jim and Nick Schwalbach this week on possible considerations that could be added to their request for <br />outdoor storage changes so that it was not so broad. City staff was clear with the Schwalbach’s that <br />the suggestions we were making were not intended to imply this would result in the approval of their <br />application. Rather, our ideas were merely a means for scaling back some of the outdoor storage and <br />finding avenues to regulate and verify who is using that space. Below are the ideas staff presented for <br />consideration: <br />Interim Use Permit for non-occupants of building in any district expires annually (or a <br />shorter duration than five years). Note: The current language reads “for a period of not <br />more than five years from the approval date”. The allowance to issue a shorter IUP duration <br />is already provided for in the ordinance, but when it is applicable to a non-occupant in any <br />district then it is with the understanding those are issued on a shorter basis. A shorter time <br />period would give us a better change to address problems that may arise. <br />Limit the number of non-occupants from any district that are allowed to rent outdoor storage. <br />Note: The current IUP’s issued have been requested for one specific non-occupant of the <br />building. <br />Verification of residency through evidence of home ownership or property. Would not be <br />allowed to rent outdoor storage to a renter or someone living in a house due to verification. <br />They must own the property. Note: In the Schwalbach scenario, the son lives with his <br />mother and does not own the property. The suggestion was made that it could be verified <br />through a utility bill in their name. <br />Updated site plan that shows outdoor storage area dedicated by uses (e.g. occupant area, non- <br />occupant area, fire lanes). <br />List of exceptions for which non-occupant rental outdoor storage would not be allowed (i.e. <br />no auto related uses, outdoor storage that exceeds height of the fence or 8 feet as allowed in <br />I-1). <br />Further discussion on whether or not a homeowner in Little Canada with a semi-truck that is <br />looking for storage of their vehicle would fall under the Interim Use provision. <br />The Schwalbach’s were very understanding of concerns and agreeable to modifications of their <br />application. Therefore, included in your agenda is a letter from Jim Schwalbach with additional <br />suggestions they’d propose for non-occupant outdoor storage being allowed on their property from any <br />district in Little Canada. I will mention that the Schwalbach’s did not submit a site plan for the layout
