<br />5. The provisions of Section 921.010.C of this Ordinance are considered and satisfactorily <br />met. (Ordinance language to follow) <br /> <br /> The Planning Commission shall review. <br /> <br />C. The Planning Commission shall consider possible adverse affects to the proposed <br />amendment or conditional use. Its judgment shall be based upon (but not limited to) the following <br />factors: <br /> <br />1. The applicant shall demonstrate by clear and convincing evidence that the proposed action <br />has been considered in relation to the specific policies and provisions of and has been <br />found to be consistent with the official City Comprehensive Land Use Plan. <br /> <br />2. The applicant shall demonstrate by clear and convincing evidence that the proposed site is <br />or will be compatible with present and future land uses of the area. <br /> <br />3. The applicant shall demonstrate by clear and convincing evidence that the proposed use <br />conforms with all performance standards contained herein. <br /> <br />4. The applicant shall demonstrate by clear and convincing evidence that the proposed use <br />will not tend to or actually depreciate the aggregate property values in the area in which the <br />amendment or conditional use is proposed. <br /> <br />5. The applicant shall demonstrate by clear and convincing evidence that the proposed use <br />can be accommodated with existing public services and will not overburden the City's <br />service capacity. <br /> <br />6. The applicant shall demonstrate by clear and convincing evidence that the development of <br />the conditional use shall reflect the architectural character of the conforming buildings in <br />the surrounding area in regard to the following: <br /> <br />a. Proportion, scale and roof line; <br />b. Architectural style; and <br />c. Exterior finish materials. <br /> <br />The applicant has included in their submittal a business plan that includes how they intend to regulate and control <br />the serving of alcohol in conjunction with the pool tables. In addition, city staff has been made aware that the <br />exterior lighting has been upgraded, additional building lighting has been installed as well as a surveillance cameras <br />to monitor the parking lot. <br /> <br />Recommendation <br />Subject to the following conditions it is Planning Staff’s recommendation that a Conditional Use Permit be <br />approved for 80 Little Canada Road E. to allow for a commercial recreational pool hall use serving alcohol – <br /> <br />1. Upon approval and compliance with the City’s liquor licensing requirements and subject to any <br />conditions deemed necessary as part of this licensing. <br /> <br />2. That the billiard hall is limited to a maximum of sixteen pool tables. Expansion of the business to <br />increase beyond twelve pools tables would require an amendment to the PUD Permit to allow city <br />staff, Planning Commission, and City Council the ability to review the compatibility of use with <br />the area and within the multi-tenant building. <br /> <br />3. A six month and one year review of the Conditional Use Permit to verify if there have been any <br />issues with noise or other concerns related to the billiard hall use in conjunction with serving <br />alcohol.
