MINUTES <br />CITY COUNCIL <br />AUGUST 23, 2017 <br />PUBLIC HEARING <br />Keis opened the public hearing. <br />-PUD <br />AMENDMENT TO <br />The Associate Planner reported that Nathan Badger is one of the owners of <br />ALLOW A <br />TNT Billiard Products and Pool Hall at 80 Little Canada Road East, and <br />CONDITIONAL <br />has requested to sell alcohol at the pool hall. She explained that a pool <br />USE PERMIT FOR <br />hall is allowed in this Planned Unit Development (PUD) district, but the <br />COMMERCIAL <br />alcohol sales are only allowed with a conditional use permit. She stated <br />RECREATIONAL <br />that this business has been open for a couple of months, and they also have <br />POOL HALL USE <br />a retail area and repair shop within their space. She reported that they <br />WITH ALCOHOL <br />have complied with all licensing, building and fire code requirements, and <br />SALES <br />with the Zoning Code requirements for commercial recreation uses. She <br />noted that TNT Billiards is expanding in September and will then have 12 <br />pool tables. The Associate Planner stated that the property is zoned <br />Planned Unit Development, along with most of the surrounding properties, <br />although some are legal non -conforming single-family residential uses. <br />The Associate Planner reviewed the hours the business is open and stated <br />that staff has determined there is enough parking since the billiard hall will <br />use most of their parking needs after 6:OOpm on weeknights, so the <br />parking should work, with this use. She noted that since it is a multi -tenant <br />building, staff does not want to overburden the site. <br />The Associate Planner stated that Staff recommends that a conditional use <br />permit be approved to allow for a commercial recreational pool hall use <br />serving alcohol, subject to three conditions: <br />1. Upon approval and compliance with the City's liquor licensing <br />requirements and subject to any conditions deemed necessary as part <br />of this licensing. <br />2. That the billiard hall is limited to a maximum of 12 pool tables. <br />Expansion of the business to increase beyond 12 pool tables would <br />require an amendment to the PUD permit to allow city staff, Planning <br />Commission and City Council the ability to review the compatibility <br />of use the area and within the multi -tenant building. <br />3. A six month and one year review of the conditional use permit to <br />verify if there have been any issues with noise or other concerns <br />related to the billiard hall use in conjunction with serving alcohol. <br />Keis questioned the capacity of the building. Nathan Badger stated that <br />the fire marshal has been there, but they have not gotten information about <br />capacity yet. Tom Kjos, one of the owners of TNT Billiard Products, <br />stated there is seating that accommodates about 60 people along with the <br />pool table area. McGraw asked how big their tournaments are. Mr. <br />Badger stated there would typically be 24 people playing along with <br />observers, but they are not big enough to hold team tournaments. Mr. <br />2 <br />
