MINUTES <br />CITY COUNCIL <br />AUGUST 23, 2017 <br />rental outdoor storage is not provided for in any PUD or other commercial <br />zoning districts. She stated that Mr. Schwalbach purchased this property <br />from the City in 2015 and applied for an Interim Use Permit to allow for <br />non -occupant of the building outdoor storage, but the request was <br />amended at the City Council meeting and Mr. Schwalbach indicated that <br />the building would be multi -tenant and the outdoor storage area would be <br />used solely by tenants leasing building space. <br />The Associate Planner stated that in 2008, one of the property owners in <br />the industrial area asked to be able to lease outdoor storage space to Q3, <br />who is another Little Canada industrial business, and this request created a <br />Code amendment to allow an Interim Use Permit for outdoor storage to <br />non -building tenants up to five years. She noted that a few property <br />owners have taken advantage of an Interim Use Permit. <br />The Associate Planner reported that Staff met with the applicants after the <br />Planning Commission meeting to see if there were other options they <br />would be agreeable to, and they have since submitted an amended request. <br />She stated that Staff originally did not recommend approval of the PUD <br />amendment based on past Council discussions, but since the applicant has <br />made changes to their request, Staff is looking for direction from the <br />Council if code amendments should be drafted. She reported that Staff <br />suggested possibly going back to an Interim Use Permit that expires <br />annually, limiting the number of non -building occupants allowed, or <br />establishing a verification process of business residency through utility <br />billing. She noted that the applicant's amended request states they would <br />still follow I-1 and I -P zoning regulations and Interim Use Permit <br />regulations for outdoor storage, limit outdoor storage usage to two non - <br />building occupants, and if a tenant is renting at least 25% of building, they <br />could rent as much of the outdoor storage area as available. <br />McGraw stated that the Council had a number of meetings with the <br />industrial property owners several years ago and finally came to some <br />agreements, which he feels were good, and he does not want to open this <br />up again without discussion at a workshop. Fischer stated that he believes <br />this particular applicant would do a good job managing the outdoor <br />storage, but code amendments would open it up to everyone and he does <br />not believe that all property owners will manage the outdoor storage as <br />well, and stated that he would need to be convinced in order to open this <br />up again. Torkelson stated that he understands this situation shows the <br />restrictions of the City Code, but he is not willing to support changes to <br />the outdoor storage code without more discussion. Keis stated that he <br />cannot support these changes without some very good reasons. <br />5 <br />
