MINUTES <br />CITY COUNCIL <br />AUGUST 30, 2017 <br />willing to compromise in accepting the 250 capacity number for now, and <br />at renewal, go up to 300 and 350 when patio is open, if there have been no <br />major issues, and hopefully work their way up to a higher number. Mr. <br />Duray stated that until the last few months they were near 450 capacity on <br />weekend nights so they are used to dealing with a lot of people. After the <br />two shooting incidents at his location and nearby Flameburger, his <br />attendance has dropped significantly, but he hopes things improve. <br />Mr. Duray stated that he had initially offered the 250 capacity during the <br />meetings with City Staff so he could get new policies and procedures in <br />place, but he did not intend to stay at that number forever. He would like <br />to be able to get back to at least 350 capacity. Montour stated that he has <br />no problem going back up to 300 or 350 in order to help the business <br />succeed. There was Council consensus to agree to the capacity increase at <br />the time of renewal in 2018. <br />Mr. Johnson stated that they agree that all entertainment and music, inside <br />and outside, will stop at 1:30am. He also stated that Mr. Duray has <br />voluntarily been wanding customers for security every night. Mr. Duray <br />agrees to add to the conditions that security staff will wand customers on <br />Sunday through Thursdays beginning at 11:00pm, and Friday and <br />Saturdays beginning at 9:00pm. <br />Mr. Johnson questioned if the City has any security requirements for the <br />Flameburger. The City Administrator stated that the City has no licensing <br />jurisdiction there so it is hard to require them to do anything. Ms. Duray <br />stated that place attracts customers from all over and is open 24 hours a <br />day and she was told they have no outside cameras. Montour suggested <br />the City ask the Flameburger owner to meet and discuss security measures <br />they are doing. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION 2017-8-152 — ADOPT THE LIQUOR LICENSE <br />CONDITIONS FOR THE HOGGSBREATH WITH THE ADDITIONS <br />DISCUSSED AND AGREED UPON TONIGHT <br />The foregoing resolution was duly seconded by Fischer. <br />Aye (5). <br />Nays (0).
