MINUTES
CITY COUNCIL
SEPTEMBER 27, 2017
The Associate Planner stated that during her inspection of his site in
August, Mr. Erdmanis could not identify 10 pieces that he had gotten rid
of. Mr. Erdmanis stated that he has more pieces up for sale now and is
making progress. He noted that he needs to get rid of the tree service
company since they stopped paying rent, and has started the legal process
to evict them. Fischer stated that this issue has been going on for more
than the year since the Council's involvement. He would like to see the
135,000 square feet marked off, Mr. Erdmanis should identify specific
pieces that he is removing to staff, and he wants a deadline for
compliance. McGraw stated that he understands the time Mr. Erdmanis
needed to deal with the lawsuit, but he completely agrees with Fischer and
wants a timeline from his attorney on when the eviction will occur. Mr.
Erdmanis stated that he intends to comply and thinks he is close. Keis
stated that they want some concrete milestones to ensure he is making
progress. The City Administrator clarified that as long as the tree service
tenant is there, the property is not in compliance. He stated that the
Council is directing Mr. Erdmanis to identify equipment to be removed,
verify outdoor storage area square footage, and submit a timeline to the
City from his attorney on the eviction process of the tree contract tenant.
APPROVE
The City Administrator stated that when the Council sold the old public
EXTERIOR
works building at 3100 Country Drive, the City agreed to provide an
ENHANCEMENT
incentive of one to one matching funds up to $50,000 to offset the costs of
PAYMENT TO
enhancing the building's fagade and other exterior improvements that are
3100 COUNTRY
visible from Country Drive. He explained that Jim Schwalbach, the
DRIVE, LLC
owner, submitted the invoices for installing gutters, painting the building
and overhead doors, landscaping, repair of the overhead doors and stain
for the fence. The total cost of that work was $23,336.47. He noted that
Mr. Schwalbach has indicated that this is all of the work that will be done
under the incentive.
Montour introduced the following resolution and moved its adoption:
RESOLUTIONNO. 2017-9-174 APPROVING PAYMENT FOR
EXTERIOR ENHANCEMENTS TO 3100 CO UNTRYDRIVE, LLC IN
THE AMOUNT OF $11,668.24 AS PER THE PURCHASE
AGREEMENT
The foregoing resolution was duly seconded by McGraw.
Ayes (5).
Nays (0).
