Any party aggrieved by this decision <br />may seek judicial review pursuant to Minn. Stat. §§ 14.63 to 14.69 (2016). <br /> <br /> <br /> <br />MEMORANDUM <br />Factual Background <br />As part of the franchise renewal negotiations between the parties, Comcast <br />agreed to provide complimentary cable service to schools, libraries, and other <br />community institutions within its North Suburban service area. Under federal law, local <br />franchising authorities may not require these complimentary services as a condition to <br />renewing the cable franchise, but Comcast often provides such services as a brand- <br />building, goodwill initiative to the communities it serves.1 <br />Additionally, under the Franchise Agreement, Comcast agreed to set-aside six <br />Standard Definition format channels, and two High Definition format channels, for each <br />city to deliver public, educational and government programming – known collectively as <br />“PEG access” or “PEG Channels”. Comcast likewise agreed to provide “free of charge <br />to the City, the Commission, or its designated entities … such equipment as may be <br />necessary to facilitate the cablecasting of the PEG Channels in accordance with the <br />requirements of the Franchise.”2 This pledge includes the provision of one High <br />Definition connection and related equipment for use by the producers of PEG channel <br />High Definition programming.3 <br />Also, generally within the Twin Cities market, Comcast has agreed to provide up <br />to three converters (set-top boxes or digital adapters) for complimentary cable services <br /> <br />1 Declaration of Steve Holmes, at 1-2 (August 11, 2017). <br />2 Affidavit of Michael R.
