STAFF REPORT

TO: Mayor Keis and Members of the City Council

FROM: Joel Hanson, City Administrator

DATE: December 15, 2017

RE: Small Cell Wireless

Earlier this year, the Telecommunications Right-of-Way law was amended to create a separate
permitting process for placement of small cell wireless facilities on city-owned structures in the right-
of-way. Cities that did not already have an ordinance would be granted until January 1, 2018 to adopt
an ordinance.
Staff has been working with Attorney Mike Bradley on an ordinance for Little Canada. Unfortunately,
this was not going to be ready for adoption prior to the end of the year. Although I do not believe we
will likely see a flood of permits coming in on January 1st, we do not want to be caught without some
regulations in place since our existing Telecommunications ordinance does not cover this. Therefore, I
am proposing we adopted the League of Cities’ ordinance at this time. I have also included with this
memo a copy of the LMC handout on Small Cell Wireless for additional information on this issue.
When Mr. Bradley has completed his ordinance, we can repeal this one and adopt his while still being
protected in the meantime.
