<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Joel Hanson, City Administrator <br /> <br />DATE: December 15, 2017 <br /> <br />RE: Small Cell Wireless <br /> <br />Earlier this year, the Telecommunications Right-of-Way law was amended to create a separate <br />permitting process for placement of small cell wireless facilities on city-owned structures in the right- <br />of-way. Cities that did not already have an ordinance would be granted until January 1, 2018 to adopt <br />an ordinance. <br />Staff has been working with Attorney Mike Bradley on an ordinance for Little Canada. Unfortunately, <br />this was not going to be ready for adoption prior to the end of the year. Although I do not believe we <br />will likely see a flood of permits coming in on January 1st, we do not want to be caught without some <br />regulations in place since our existing Telecommunications ordinance does not cover this. Therefore, I <br />am proposing we adopted the League of Cities’ ordinance at this time. I have also included with this <br />memo a copy of the LMC handout on Small Cell Wireless for additional information on this issue. <br />When Mr. Bradley has completed his ordinance, we can repeal this one and adopt his while still being <br />protected in the meantime.
