<br /> The property at 3100 Country Drive is zoned PUD District D which says “PUD <br />"D" District is to provide for industrial uses as outlined in Section 914 of the <br />Zoning Ordinance at 3100 Country Drive, Parcel ID Number 06-29-22-11-0019. <br />All Permitted, Accessory, Conditional, and Interim Uses shall be allowed as <br />prescribed in said Section 914, subject to the processing requirements of the <br />applicable zoning regulations in effect at the time.” The owners of 3100 <br />Country Drive could apply for an IUP under our current code language, but it <br />would be to a business zoned I-1 or I-P. The Hardware Hank property is zoned <br />PUD. This amendment scenario would allow for 3100 Country to apply for an <br />Interim Use Permit and have off-site outdoor storage from Hardware Hank since <br />the language is expanded to include properties zoned PUD. <br /> <br /> Add a provision to I-1 Interim Use Permit, Off-Site Outdoor Storage – The owner of the <br />storage material owns and operates a home based business in Little Canada in a Residential <br />zoning district. The business owner must also own the residential property which can be <br />verified through Ramsey County Property Records. <br /> This provision should also consider whether or not to allow an occupant of <br />property, but not specifically the owner. In the Schwalbach’s scenario it is a son <br />still living at home, but occupants may also include renters. Staff’s concern <br />with this point would be the ability to verify if they are a permanent/full-time <br />resident/occupant of property (i.e. utility bill was one example given for <br />verification). <br /> <br /> Add a provision to I-1 Interim Use Permit, Off Site Outdoor Storage – The owner of the <br />storage material owns the Property for which the off-site outdoor storage is located and they <br />also own a business in Little Canada in either a Business, Industrial, or PUD District. <br /> This provision addresses the matter of common ownership and allows for off- <br />site outdoor storage under this scenario. This amendment would apply to the <br />example of Hardware Hank and 3100 Country Drive LLC property as there is <br />common ownership. However, this provision would not be applicable to <br />Hardware Hank in the future should the Schwalbach’s sell the business. (Note: <br />The amendment above (bullet point #1) would be needed if the Schwalbach’s no <br />longer owned the Hardware Hank business because that property is zoned PUD. <br />Current ordinance language only allows off-site outdoor storage to a Little <br />Canada business zoned I-1 or I-P.) <br /> <br /> Amendment to I-1 Conditional Use Permit for Outdoor Storage 914.040.G.4 - The storage <br />is utilized solely by those tenants of the principal building. The amount of outdoor storage <br />area allocated to each tenant is an amount proportionate to each tenant’s occupancy of said <br />principal building. In a multi-tenant building, if one tenant does not have a need for <br />outdoor storage, then the Property Owner may allocate additional outdoor storage area to <br />another tenant of the building only if that tenant occupies more than 30% of the building. <br /> This amendment language would not apply to 914 Interim Use Permit for Off- <br />site Outdoor Storage since that provision states “The storage area meets all of <br />the conditions for outdoor storage listed in Section 914.040.G as if it were <br />accessory to the principal use on the subject parcel, with the exception of <br />914.040.G.4 of this Ordinance.” The reason behind that is with the Interim Use <br />Permit the applicant is submitting a site plan that shows the designated outdoor
