Attachments Exhibit A: Legal Description <br />Exhibit B: Planning Staff Report <br />(dated 08/22/2017) and City Council Memorandum <br />(dated 09/20/2017) -without enclosures <br />Exhibit C: Applicable Plans <br />Exhibit D: Resolution 17-09-187 <br /> <br />Intent and Purpose of This Agreement <br />The purpose of this agreement ("Agreement") is to ensure that the conditions of approval <br />established by the City of Little Canada (herein referred to as "City") pertaining to the <br />Dignicare Properties I, LLC Project are understood by the Developer, and that the Developer <br />fully complies with said conditions within the time frames established by this Agreement. <br />This Agreement outlines the requirements pertaining to the Project and the Property. <br />Conditions of Agreement <br />Article 1 - Scope and Content <br />At its March 14, 2018 regular meeting, the City Council approved a Final Plat, Planned <br />Unit Development (PUD) Permit, Architectural Review, and Master Signage Plan for <br />the Project at 2736 & 2744 Rice Street. <br /> <br />This Agreement documents the approvals granted concerning the current Project, and the <br />Developer and Owners' conditions associated therewith. <br /> <br />The Property totals 1.73 acres (75,358.80 square feet) and is designated as Planned Unit <br />Development on the Land Use Plan. <br /> <br />The requests associated with the Project were approved with the following conditions: <br /> <br />1. Final PUD plans are submitted verifying compliance with the terms of the PUD approvals <br />noted in this report. <br />2. Any comments or conditions imposed by the City Engineer after his review of the utilities and <br />stormwater improvements, including the drainage and utility easement, to ensure compliance <br />with the City Policy. They are as follows: <br /> <br />Preliminary/Final Plat <br />1. A revised preliminary/final plat was not included with the submittal. A revised <br />plat should be provided that addresses the comments made to the Planning <br />Commission on February 8th, 2018. <br />Utility Plan Details <br />1. All watermain fitting bolts noted on the Wet Tap detail should be stainless <br />steel. <br />Drainage Calculations <br />1. The impervious area in the revised storm water narrative has been reduced <br />by 0.05 acres from the original document. In a review of the plan we cannot <br />easily identify where the reduction has occurred. An electronic AutoCAD <br />drawing should be provided so that the area can be confirmed. <br />2. The proposed drainage calculations should be modeled without infiltration to <br />determine the effects on the system if the infiltration/filtration ability of the <br />basin ceases to operate as designed. <br />3. The storm water narrative discusses the required draw down area of the <br />filtration basin. The required area should be based on the actual volume <br />8
