2 <br /> <br />The site is bordered by commercial uses to the north, south and west and by Interstate <br />35E to the east. <br /> <br /> <br />ISSUES AND ANALYSIS <br /> <br />CUP Evaluation Criteria. As noted, the processing of a conditional use permit and a <br />companion architectural review is necessary to accommodate the coffee shop’s <br />accessory drive though lane. <br /> <br />Conditional uses have two levels of review, based on the nature of the use. The first <br />level are those general standards that govern the review of uses in the conditional use <br />category. The second level are those specific standards that apply to use itself, <br />whether those are listed in the zoning ordinance, or they are identified as relating to a <br />specific parcel or business location. <br /> <br />The general ordinance standards are as follows: <br /> <br />921.010.C. The Planning Commission shall consider possible adverse effects to <br />the proposed <br />amendment or conditional use. Its judgment shall be based upon (but not limited <br />to) the <br />following factors: <br /> <br />1. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Land Use Plan. <br /> <br />2. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of the <br />area. <br /> <br />3. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br /> <br />4. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property <br />values in the area in which the amendment or conditional use is proposed. <br /> <br />5. The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br /> <br /> <br />
