Resolution declared adopted. <br />PIPELINE Mayor Fahey noted the staff research relative to the request that the City <br />SETBACK adopt a pipeline setback ordinance. He noted that the only city that staff <br />ORDINANCE has found with such an ordinance is the City of Maplewood that has a 100- <br />foot setback from the pipeline. The City of Woodbury has an informal <br />policy of requiring a 50-foot setback from the edge of the pipeline <br />easement. Fahey noted that the City has requested information from the <br />Office of Pipeline Safety about ordinances that other cities in the State of <br />Minnesota may have adopted. They did not produce that information. <br />Fahey further noted that staff put together estimated distances between <br />structures in the City and the Williams Pipeline and Amoco Pipeline. <br />Fahey pointed out that staff is recommending the City adopt a policy <br />establishing a 50-foot setback from the edge of pipeline easements. He <br />further noted that one of the issues relative to adoption of an ordinance or <br />a policy is the question about whether this would create issues of non- <br />conformity for existing lots. <br />The City Administrator suggested that the policy be applied as apart of the <br />subdivision process. He noted that in the case of The Preserve <br />development, the proposed policy would result in the elimination of one <br />lot on the east end of the plat. <br />The City Attorney expressed concern with the City's ability to enforce a <br />policy and felt that an ordinance was a more effective tool in terms of <br />enforceability. <br />6 <br />
