MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 2002 <br />with Mr. Brausen about working with him on issues related to relocation of his <br />driveway and landscape buffering. <br />Brausen stated that he did not know what the best answer was for the connection of <br />Preserve Trail to Viking Drive. However, he did note that he was unwilling to take a <br />financial loss. <br />Mrs. Arcand agreed with Mr. Brausen's comments, and noted that they will have a <br />corner lot on the northeast corner of their property. Mrs. Arcand was opposed to this. <br />Fahey asked if the new lot proposed by the developer along Preserve Trail met the <br />City's minimum standards. The City Planner replied that it did. <br />Fahey asked Brausen if he was objecting to the road connection to Viking Drive or to <br />the layout of the road. Brausen stated that he was objecting to the financial loss that <br />he would absorb as the result of his two lots becoming corner lots. Brausen also <br />pointed out that given the layout proposed for Preserve Trail, the present location of <br />his driveway to his back lot creates a nonconformity. Tlie Planner indicated that the <br />driveway location is not an issue. The issue is that the Brausen lot that most directly <br />fronts on Viking Drive becomes a corner not. Thus the sideyard setback for that lot <br />changes from 10 feet to 30 feet that results in the loss of ZO feet of buildable area. <br />Fahey noted that this is the reason that the Planning Commission is recommending <br />that Preserve Trail be constructed down the middle of the lot. The City Planner noted <br />that he is recommending Preserve Trail go down the middle of the lot that that outlots <br />be created on either side of the road. This would avoid the creation of corner lots for <br />the Brausen and Arcand properties, and provide a buffer to those lots. <br />McDonell indicated that putting the road straight down the middle rather than curving <br />it as he has proposed increases the impact on the adjacent properties. <br />Anderson noted McDonell's comments about the use of plantings to buffer the <br />impact on the Brausen property. He noted that Williams Pipeline limits plantings on <br />their easement to nothing over three feet in height. McDonell noted that there is an <br />area of the outlot adjacent to the Brausen property that is outside the Williams <br />Pipeline easement area. McDonell again stated that they would work with Mr. <br />Brausen to make sure he is happy. The developer has agreed to relocate his <br />driveway, and they are willing to add landscaping to help maintain the views of all <br />the existing property owners in the area. <br />LaValle asked what working with the property owners meant. LaValle asked if this <br />meant that monetary compensation would be paid by the developer to Mr. Brausen <br />for his loss of property value. McDonell replied that working with the property <br />owners meant working on design issues. Monetary compensation is an issue that <br />would have to be addressed with the developer- McDonell indicated that it was his <br />
