MINUTES <br />CITY COUNCIL <br />OCTOBER 23, 2002 <br />RECOMMENDED 73Y THE CITY PI ANNER AND THE Pl ANNINC <br />COMMISSION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Scalze, Montour, Anderson. <br />Nays (0). Resolution declared adopted. <br />Fahey felt that given the pipeline breaks that have occurred in this area, he feels the <br />City is on the right track in applying its 50-foot setback policy to The Preserve <br />development. Fahey felt that the Council should take action on the preliminary plat <br />and approve the plat subject to compliance with the recommendations of the City <br />Planner, City Engineer, City Administrator, and the Planning Commission. Fahey <br />noted that the 50-foot setback policy would also apply. Once approval of the <br />preliminary plat is granted, the developers will have to make a decision as to whether <br />or not they want to proceed under the City's conditions. <br />Barbara Allan indicated that she was still seeking cla~~ification on the easement <br />question. McDonell explained the content of some e-mail discussions, noting that <br />Liz Babcock of Williams Pipeline confirmed that their easement does not extend <br />from the Brausen property onto the Palmer property. <br />Fahey noted that one of the recommendations is the requirement of title work to <br />clarify the easement question. This detail will be clarified before action is taken on a <br />final plat. <br />Allan asked why the outlots are being eliminated. McDonell pointed out that the <br />outlots will be incorporated into the developable lots. Easements will be obtained for <br />the ponding areas rather than platting these as outlots. Allan noted that changes in <br />the plat will have to be submitted to the Watershed for review. <br />Allan noted the DNR protected body of water to the north of the development. Allan <br />requested that this lake area be shown on the development plans. <br />Scalze noted that the plat will have to be submitted to the Parks & Recreation <br />Commission relative to the City's park dedication requirements. The City <br />Administrator indicated that there have been some preliminary discussions of this <br />development by the Parks & Recreation Commission, but agreed that the plat will <br />have to be presented to the Commission for final action. <br />Anderson noted that the preliminary discussions included access from the cul-de-sac <br />to the wetland area for the possible improvement of a boardwalk into the wetland. <br />Allan requested that the topography information for the development include the 968 <br />elevation at the eastern edge of the property to reflect the 100-foot drop in elevation <br />in that area. <br />16 <br />
