1VIINUT'ES <br />CITY COUNCIL <br />OCTOBER 23, 2002 <br />McDonell again noted that if additional lines are added, they will be added south of <br />the existing lines, furthest from the road. McDonell felt it would make no sense to <br />add the lines to the north of the existing pipes. McDonell also noted that Preserve <br />Court is proposed at 1,500 feet in length, and it is only approximately 275 feet of <br />paved road that actually touches the easement area. Potential cost of replacement is <br />$10,000. <br />Fahey pointed out that the road right-of--way can be pulled out of the easement area <br />and the development will still work. McDonell indicated that they have already <br />moved the road and, as a result, lost two lots. McDonell indicated that there are <br />already been numerous revisions to the plat to get to the point it is this evening. <br />Fahey asked what the impact is on the plat of moving the road right-of--way from the <br />easement. McDonell estimated that half of the proposed lots would be lost. He <br />estimated that 5 lots on the western edge of the plat would be eliminated and 2 would <br />be lots on the eastern edge. <br />McDonell indicated that they have worked with the Office of Pipeline Safety, <br />Williams Pipeline, and the Watershed on this plat. Every agency has been happy <br />with the project as proposed. <br />Fahey pointed out that these agencies review the plat from their given areas of <br />responsibility, and that is just a small piece of the puzzle. Fahey stated that he has no <br />objection with the development of this land, but pointed out that the development <br />needs to comply with the requirements of the City. Fahey stated that it is not unusual <br />for developers to want to maximize the development of a piece of property, and often <br />times developers are not able to get as many lots as they propose. <br />McDonell indicated that the preliminary plat meets the City's Subdivision Codes and <br />noted that no variances are being requested. He noted that they have agreed to <br />comply with the recommendations of the City Engineer on engineering issues and <br />have agreed to provide appropriate landscaping. McDonell stated that he does not <br />mean to reduce the importance of what is being discussed this evening, but felt that at <br />some point we must work with the reality that it is unlikely the road will be touched. <br />Fahey noted that if the City requires the road right-of--way outside the Williams <br />Pipeline easement, then the reality is that the road will not be touched. Fahey pointed <br />out that the developer is asking the City to accept the risk of the cost of replacing the <br />road should Williams need to work within their easement and disturb the road. Fahey <br />felt that expectation on the part of the developer was unreasonable, and pointed out <br />that the solution for the City is very simple, and that is to not allow the road right-of- <br />way within the easement area. <br />6 <br />
