<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: July 3 , 2018 <br /> <br />RE: 3100 Country Drive – PUD Amendment <br /> <br />Jim Schwalbach, Property Owner of 3100 Country Drive, applied last fall for a Planned Unit <br />Development (PUD) Amendment that would allow for non-tenant outdoor storage for businesses that <br />are located off-site in any zoning district. That application was denied in order to allow for further <br />review of possible text amendment language. A workshop between the Planning Commission and City <br />Council was held in October 2017 to review several proposed code amendments to the Conditional <br />Use Permits and Interim Use Permits provisions as it relates to outdoor storage in the I-1 District. <br />From that discussion, code amendments have been adopted and Mr. Schwalbach is now reapplying for <br />approval of non-tenant outdoor storage for a residential home based business in Little Canada. <br /> <br />This property is zoned Planned Unit Development, PUD District D. The existing PUD Permit allows <br />for accessory outdoor storage to tenants of the building as prescribed in Section 914 – I-1, Light <br />Industrial. The building is occupied by Hardware Hank and MGT Insulation. Currently, Hardware <br />Hank is the only user of tenant outdoor storage. <br /> <br />PUD Amendment <br />Below are the conditions (with staff comments in italics) for Interim Use off-site (non-tenant) outdoor <br />storage within the I-1 zoning district: <br /> <br />914.045. INTERIM USES (Requires an interim use permit based upon procedures set forth in and <br />regulated by Section 921 of this Ordinance.) <br /> <br />A. Off Site Outdoor Storage, provided that: <br /> <br />1. The Property Owner of the location for the off-site outdoor storage obtains a license for outdoor <br />storage as required by the City, if one has not already been issued to the owner under Section <br />914.040.G. <br /> <br />Mr. Schwalbach has an outdoor storage license for tenants of the building valid until June 30, <br />2019. Upon approval, city staff will complete an inspection for compliance with the site plan <br />submitted and the license would also include the non-tenant outdoor storage. <br /> <br />2. This interim use permit may not be utilized for the off-site storage associated with an auto <br />related business (i.e. auto repair, auto sales, auto salvage) for motor vehicles or parts of motor <br />vehicles. <br /> <br />Mr. Schwalbach has indicated that Quinzon Construction will be utilizing the outdoor storage <br />area for truck(s), trailer(s), and equipment relating to lawn care and landscaping.
