<br /> <br />3. The owner of the storage material owns and operates a business (the “operator”) in Little <br />Canada which is legally established in either a Business, Industrial or PUD District. The <br />Business Owner may also operate a home based business that complies with City Code Section <br />903.120 in a Residential zoning district. The Business Owner must provide evidence of <br />occupancy in Little Canada (i.e. utility bill, property tax records, rental agreement, business tax <br />statement). <br /> <br />Quinzon Outdoor Services operates a home based business in the R-1, Single Family <br />Residential zoning district. Jeremy Quinzon, Business Owner, has submitted his driver’s <br />license, AT&T bill for Company, and a Certificate of Insurance which shows his name tied to <br />the Little Canada address. <br /> <br />4. The location of the off-site storage is zoned I-1 (the “off-site location”). <br /> <br />3100 Country Drive is zoned PUD District D which allows for those Conditional Uses and <br />Interim uses as allowed in the I-1 District. Therefore, the proposed use would be allowed. <br /> <br />PUD Code Language: <br />915.070. PUD Zoning District "D". The Purpose of the PUD "D" District is to provide <br />for industrial uses as outlined in Section 914 of the Zoning Ordinance at 3100 Country Drive, <br />Parcel ID Number 06-29-22-11-0019. All Permitted, Accessory, Conditional, and Interim Uses <br />shall be allowed as prescribed in said Section 914, subject to the processing requirements of the <br />applicable zoning regulations in effect at the time. <br /> <br />5. The storage area meets all of the conditions for outdoor storage listed in Section 914.040.G as if <br />it were accessory to the principal use on the subject parcel, with the exception of 914.040.G.4 of <br />this Ordinance. <br /> <br />The proposed non-tenant outdoor storage is an accessory use with tenants of the building also <br />sharing in the outdoor storage area. Staff is requesting the Applicant submit an updated site <br />plan that shows the outdoor storage area designated by tenant and non-tenant areas. This site <br />plan subject to approvals could be updated with staff if spatially areas are changing. The <br />intention of having a site plan that shows the designated areas is so that staff can identify <br />during an inspection where each use exists and which use(s) (i.e. CUP for tenants, IUP for non- <br />tenants) are occurring. <br /> <br />6. The off-site location is found to be in full compliance with all applicable zoning regulations at <br />the time of application, and have had no history of zoning violations in the previous twelve (12) <br />months. <br /> <br />The City has not received any code enforcement complaints regarding Quinzon Outdoor <br />Services, 2605 Stark Street. <br /> <br />7. An interim use permit will have a termination date for a period not to exceed more than five (5) <br />years from the date of approval as set by the City Council. <br /> <br />City staff would recommend the Interim Use Permit be valid for five years from the date of <br />approval to allow for non-tenant outdoor storage to Quinzon Outdoor Services. <br /> <br />An amendment to the IUP would be required if the user of the off-site outdoor storage changes <br />or if to add other non-tenant businesses. This allows the City the ability to verify compliance <br />with the above provisions.
