MINUTES <br />CITY COUNCIL <br />NOVEMBER 13, 2002 <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-11-259 -ACCEPTING THE RECOMMENDATION OF <br />THE CITYADMINISTRATOR NOT TO REFUND THE TEMPORARY SIGN <br />DEPOSIT FOR .IR'S POWERHOUb'E GYM GIVEN THE PRECEDENT THAT <br />SUCH AN ACTION WOULD E.4TARLLSH <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (2) Scalze, Montour. <br />Nays (1) Anderson. Resolution declared adopted. <br />REQUEST Council reviewed the request of Daniel Byrne for an exemption from the <br />F'OR requirement of residential refuse collection as established by the City's <br />ORGANIZED Organized Collection Ordinance. It was noted that Mr. Byrne has previously <br />COLLECTION has a residential exemption given that he owned and operated a business within <br />EXEMPTION - Little Canada. However, that business has been moved outside the City; <br />DANIEL BYRNE therefore, under the provisions of the Ordinance, residential collection must be <br /> resumed at Mr. Byrne's home. <br />Scalze noted the work that was done in establishing organized collection in Little <br />Canada. She also noted that the Council has been faced with similar requests for <br />residential exemptions, and the only residential exemptions that are allowed are for <br />residents who own and operate businesses within the City. <br />The City Administrator indicated that this provision is common to organized <br />collection ordinances that other cities have adopted. He also noted while the City is <br />able to verify ownership and refuse collection arrangements of businesses that exist <br />within the City, it becomes very difficult to verify this situation when the businesses <br />are located in other cities. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOI. ORGANIZED COLLECTION EXEMPTION <br />RASED ON THE RECOMMENDATION OF CITY.S'TAFF <br />The foregoing resolution was duly seconded by Anderson. <br />Ayes (3) Montour, Anderson, Scatze. <br />Nays (0).
