MINUTES <br />CITY COUNCIL <br />NOVEMBER 20, 2002 <br />The City Administrator noted that the rezoning to I'UD can be <br />processed in the December meeting cycle. <br />Mr. Johnson was unsure as to the impact of the PUD zoning versus I-1 <br />zoning. Fahey noted that the PUD zoning will allow Mr. Johnson to <br />utilize the property as has been discussed. However, any future <br />owners of the property with uses different than Mr. Johnson's will <br />have to obtain City Council approval for their use. Fahey noted that <br />the City has had significant enforcement problems relative to outdoor <br />storage uses. Therefore, the Council wants to ensure that the City has <br />the control it needs to avoid problems in the future. Fahey noted that <br />the plat as proposed is acceptable, and the Council is agreeable to the <br />third canopy remaining in place provided that a stucco finish is added. <br />The City Administrator noted that a key issue is completion of the <br />development agreement between the City and Mr. Johnson. The <br />development agreement can be processed during the December <br />meeting cycle along with the rezoning to PUD. <br />There was no one present from the general public wishing to comment <br />on this matter. <br />Upon motion by Fahey, seconded by Scalze, the public hearing was <br />closed. <br />Fahey introduced the following resolution and moved its adoption: <br />RESOI UTION NO. 2002-11-276 -GRANTING CONCEPT <br />APPROVAL TO THE DRYWALL. SUPPYADDITIDNAS <br />PROPOSED SUR.IECT TO EXECUTION OF A DEVELOPMENT <br />AGREEMENT 73ETWEEN MR..IOHNSON AND THE CITY, AND <br />CALL LNG FOR A PUBLIC HEARING TO CONSIDER THE <br />REZONING OF TILE ENTIRE PARCEL. FROM73US7NESS- <br />WAREFIOUSE (E-i~ TO PLANNED UNIT DEVELOPMENT <br />(PUD) <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Fahey, Scalze, Montour, Anderson. <br />Nays (0). Resolution declared adopted. <br />Montour introduced the following resolution and moved its adoption: <br />REb'O7 UTION NO. 2002-I1-277 -DENYING THE REZONING <br />OF THE BACK PORTION OF THE DRYWALL .S`UPPLY <br />
