Z:\PROJ\120218E - Q3 South Owasso Site\Memo-082218-CC (Easement Actions & Update).doc <br /> <br />10062 Flanders Court NE – Blaine, MN 55449 – (763) 780-0450 fax (763) 780-0452 <br /> <br /> <br />Memorandum <br /> <br /> <br />TO: Little Canada Mayor and City Council Members <br /> <br />FROM: Lee Elfering, City Engineer <br /> <br />DATE: August 22, 2018 <br /> <br />RE: Easement Actions for 53 & 167 South Owasso Blvd. <br /> Q3 Development Update <br /> <br /> <br />Access and Utility Easement <br />Attached to this memo is a copy of the new easement document to provide driveway and <br />utility access from South Owasso Blvd. to the two City owned properties proposed to be <br />sold to Q3/PSC. There is an existing access easement to the properties, however the <br />current driveway alignment is not fully within the existing easement and the existing <br />easement does not allow the installation of utilities. It has been mutually agreed by all <br />parties involved that it is preferred to keep the driveway access to the properties in the <br />current location to limit the impacts the improved entrance will have on Advantage Sign’s <br />use of their property. This document modifies the easement location to match the <br />driveway and allows for utility construction in the same corridor. <br /> <br />Once the new easement is executed there is no purpose for the existing access <br />easement and it should be terminated. The easement is a private easement in favor of <br />the two private properties currently owned by the City and serves no other parcel. <br />Therefore, there is no need for public noticing of the termination or having a public <br />hearing. We are asking the City Council to authorize the Mayor and City Administrator <br />to execute a termination agreement for the existing access easement that was executed <br />on June 5, 1968 and recorded on July 8, 1968 as document number 1727848 contingent <br />on dedication of the attached easement. <br /> <br /> <br />Development Update <br /> All items have been addressed for the sale of the cell tower leases and sale of the two <br />City parcels to Q3. The City Attorney is coordinating the final details of the agreements <br />and it is anticipated that the closings will occur before the end of the month. <br /> <br />There is one item that will need to be addressed for the Q3 development post-closing. <br />The design for the Q3 site has not been completed in sufficient detail for them to provide <br />a location for the storm sewer crossing of the Ramsey County Sheriff’s site at this time. <br />As part of the closing documents the City will be agreeing to assist Q3 in the acquisition <br />of the necessary easement after the location has been determined. <br /> <br />If you have any questions or would like to discuss any of the items listed please feel free <br />to call me at (763) 780-0450 Ext. 3.
