MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2002 <br />RESOLUTION NO. 2002-12-307 -TABLING ACTION ON THE <br />.SA I~ACiE LANE TAX DELINQUENT PROPERTY PENDING A <br />RECOMMENDATION FROM THE CITY ADMINLSTRATOR <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4) Fahey, Montour, Anderson, Scalze. <br />Nays (0). Resolution declared adopted. <br />SAC/WAC The City Administrator reviewed his recommendation that the City's <br />FEES SAC and WAC fees be based on Metropolitan Council calculations <br />retroactive to January 1, 2002. <br />Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2002-I2-308 -ADOPTING THE CITY <br />ADMINISTRATOR'S RECOMMENDATION RELATI vE TO <br />SAC/WAC FEES AS O UTL 1NED IN HLS DECEMBER 13, 2002 <br />REPORT <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (4) Fahey, Scalze, Anderson, Montour. <br />Nays (0). Resolution declared adopted. <br />CABLE Montour updated the Council on the fact that AT & T, soon to become <br />MODUM Comcast, has been notified that they are in franchise violation. The first <br />FEES violation relates to their failing to meet customer service standards as laid <br />out in the franchise agreement. The second violation is AT & T's failure <br />to pay franchise fees on cable modem services. Montour reported that the <br />FCC is considering a change in definitions related to this issue, and that is <br />the basis for AT & T's withholding of these fees. However, the franchise <br />agreement that the member cities have with AT & T specifically addresses <br />this issue and requires the payment of franchise fees on cable modem <br />service. Montour pointed out that AT & T has continued to collect these <br />fees from cable modem customers; however, are not remitting the fees to <br />the franchise cities as required under the franchise agreement. Montour <br />estimated that the fees would be in the neighborhood of $7,000 to $10,000 <br />for Little Canada. He indicated that he would keep the Council updated <br />on this issue. <br />
