<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Jessica Jagoe, Associate Planner <br /> <br />DATE: September 7, 2018 <br /> <br />RE: 200-208 Ryan Drive – Reissue Interim Use Permit, Russ Fischer <br /> <br />On June 26, 2013, the City of Little Canada approved an Interim Use Permit for Russ Fischer at 200- <br />208 Ryan Drive. The city code states that an Interim Use Permit cannot be issued for more than a five <br />year period. Therefore, Mr. Fischer is seeking renewal of the Interim Use Permit to allow off-site <br />outdoor storage to non-tenants of the building. <br />Mr. Fischer is seeking to have the IUP at 200-208 Ryan Drive reissued for another five year period. <br />Mr. Fischer has included with his application a site plan that shows the layout of the outdoor storage <br />that exists on the property. The proposed layout is the same as the previous approval. The non-tenants <br />who will be occupying the outdoor storage area are Freddy’s Tree Service and Great Northern <br />Petroleum located at 3176-3178 Ryan Lane. The outdoor storage area to the east side of the building <br />at 200-208 Ryan Drive will be a designated overflow outdoor storage area for both tenants. It should <br />be noted that Mr. Fischer does have a Conditional Use Permit that allows for accessory outdoor storage <br />to tenants of the building. Metro Cleaning who is a tenant of the building also shares in the outdoor <br />storage space on the east side of the building. <br /> <br />Analysis <br />City Code allows non-tenant off-site outdoor storage by IUP under the following conditions (staff <br />comments inserted in italics): <br /> <br />914.045. INTERIM USES (Requires an interim use permit based upon procedures set <br />forth in and regulated by Section 921 of this Ordinance.) <br /> <br />Off Site Outdoor Storage, provided that: <br /> <br />1. The Property Owner of the location for the off-site outdoor storage obtains a license for <br />outdoor storage as required by the City, if one has not already been issued to the owner <br />under Section 914.040.G. <br /> <br />Mr. Fischer has an outdoor storage license valid until June 30, 2019. City staff <br />recently completed an inspection of the property for renewal of this license and the <br />outdoor storage areas are in compliance with the site plan submitted. <br />2. This interim use permit may not be utilized for the off-site storage associated with an <br />auto related business (i.e. auto repair, auto sales, auto salvage) for motor vehicles or <br />parts of motor vehicles.
