<br /> <br />Mr. Fischer has indicated that Freddy’s Tree Care will be utilizing the outdoor storage <br />area for truck(s), trailer(s), and equipment relating to the tree company. (Note: <br />Freddy’s Tree Care had in the past stored personal automobiles that are part of <br />another side business. This has been discontinued. Mr. Fischer and Freddy’s Tree <br />Care are aware that no auto related outdoor storage is permitted.) Great Northern <br />Petroleum will have old gas station service pumps that are being recycled. <br />3. The owner of the storage material owns and operates a business (the “operator”) in <br />Little Canada which is legally established in either a Business, Industrial or PUD <br />District. The Business Owner may also operate a home based business that complies <br />with City Code Section 903.120 in a Residential zoning district. The Business Owner <br />must provide evidence of occupancy in Little Canada (i.e. utility bill, property tax <br />records, rental agreement, business tax statement). <br /> <br />Both of the non-tenant businesses are located in the Ryan Industrial Park at 3176-3178 <br />Ryan Lane which is the adjacent property to the south. This building is also owned by <br />Mr. Fischer. <br /> <br />An amendment to the IUP would be required if the user of the off-site outdoor storage <br />changes or if to add other non-tenant businesses. This allows the City the ability to <br />verify compliance with the above provisions. <br /> <br />4. The location of the off-site storage is zoned I-1 (the “off-site location”). <br /> <br />Yes, located in the Ryan Industrial Park. <br /> <br />5. The storage area meets all of the conditions for outdoor storage listed in Section <br />914.040.G as if it were accessory to the principal use on the subject parcel, with the <br />exception of 914.040.G.4 of this Ordinance. <br /> <br />Subject property meets all of the conditions. <br /> <br />6. The off-site location is found to be in full compliance with all applicable zoning <br />regulations at the time of application, and have had no history of zoning violations in <br />the previous twelve (12) months. <br /> <br />Mr. Fischer has not had any zoning code violations at 200-208 Ryan Drive within the <br />past twelve months that required enforcement action. As noted above in #2, city staff <br />did discover auto related vehicles during the last inspection, but that use has been <br />discontinued. <br /> <br />7. An interim use permit will have a termination date for a period not to exceed more than <br />five (5) years from the date of approval as set by the City Council. <br /> <br />City staff would recommend the Interim Use Permit be valid for five years from June <br />23, 2018 for non-tenant outdoor storage to Freddy’s Tree Care and Great Northern <br />Petroleum.
