AGREEMENT FOR FIRE INSPECTION SERVICES <br /> <br /> <br />This Agreement made and entered into this 9th day of January, 2019 by and between <br />the City of Little Canada, a Minnesota Municipal Corporation (hereinafter referred to as <br />"City"), and James P. Lee (hereinafter referred to as "Lee"). <br /> <br />WITNESSETH: <br />WHEREAS, wishes to contract with Lee to perform fire inspection and related services <br />within City's boundaries; and <br /> <br />WHEREAS, James P. Lee is duly qualified to perform said services; <br /> <br />NOW, THEREFORE, IT IS MUTUALLY AGREED by and between City and Lee as <br />follows: <br /> <br />A. SCOPE OF SERVICES: <br /> <br />1. Lee agrees to provide fire inspection services for City. The City Council will <br />designate Lee as the City’s Fire Marshal during the term of this Agreement. James P. <br />Lee shall be initially designated as the Fire Marshal for City following execution of this <br />Agreement. James P. Lee, designated as the Fire Marshal (hereinafter, “Fire Marshal”) <br />is authorized to delegate his duties and responsibilities under this agreement to <br />employees and/or others with whom he contracts who shall perform such services as he <br />directs under his supervision and according to the terms of this Agreement. <br /> <br />2. Except as otherwise specifically set forth herein, fire inspection services shall only <br />include those types of duties and functions customarily rendered by fire officials under <br />law and the Minnesota State Fire Code. Said duties do not include fire investigations <br />performed by Lee in any community other than Little Canada. <br /> <br />3. Lee shall conduct on-site inspections of all properties as required by the applicable <br />fire codes and Minnesota State Statutes to ensure compliance with same. Inspections <br />of all multi-family structures, schools, daycare, and group homes shall occur on an <br />annual basis. All business establishments shall be inspected at least on a bi-annual <br />basis unless, in the judgment of Fire Marshal, more frequent inspections are warranted. <br />Except as noted herein, all standards of performance, methods of providing fire <br />inspection services, as well as other matters incidental to the performance of services <br />under this Agreement including personnel to be employed shall be determined by Lee <br />upon consultation with City. <br /> <br />4. Lee shall also assist the City in the organization and management of its Inspections <br />Department including, but not limited to, ordinance reviews to ensure consistency with <br />other codes and current practices, form revisions to provide appropriate documentation <br />of services provided, policy revisions to enhance the quality of work, and preparation of <br />public information materials to make citizen dealings with the City as efficient as <br />possible based upon a customer service attitude. <br />
