5. Fire Marshal shall not be required, but may be requested from time to time, to attend <br />Little Canada City Council meetings. The Fire Marshal shall attend preconstruction <br />meetings for commercial and residential projects as needed based upon a request from <br />the City’s building official. <br /> <br />6. City shall, if requested by Lee, provide input from its fire department, police service <br />provider, public works superintendent, planning consultant, building official and other <br />staff members as appropriate <br /> <br />7. Fire Marshal shall have the exclusive initial authority to determine interpretations and <br />applications of the fire code to projects within the City. Notwithstanding the foregoing, <br />Fire Marshal shall confer with the City Administrator of City before issuing any such <br />interpretations and applications of the fire code which might have an extraordinary <br />significant effect on projects within the City. Fire Marshal shall also have the right and <br />responsibility to issue stop work orders and violations of the fire code. Enforcement and <br />prosecution of the fire code requirements by way of judicial action for either criminal or <br />civil sanction shall remain the exclusive responsibility of City. Lee shall cooperate in <br />any enforcement procedures. <br /> <br />8. Upon completion of all fire inspections, Lee shall file the original inspection records, <br />along with the plans, with the City weekly. All such inspections shall be kept on file <br />pursuant to State law. All such original records shall remain the exclusive property of <br />the City. <br /> <br />B. GENERAL TERMS AND CONDITIONS: <br /> <br />The parties further agree as follows: <br /> <br />1. Lee shall at all times during the term of this Agreement ensure that its personnel <br />remain current in terms of knowledge and familiarity with all applicable codes. Lee is <br />responsible for the training and direction of all Lee personnel. <br /> <br />2. City shall remit payment to Lee for services rendered under this Agreement. The City <br />shall not assume any liability for the direct payment of any salary, wage or benefit to <br />Lee’s principals or employees, nor shall it assume any responsibility for compliance with <br />workers’ compensation insurance statutes or tax laws relating to said personnel. The <br />City shall not make any other type of compensation directly to the person designated as <br />Fire Marshal for performing services pursuant to this Agreement. All such matters are <br />solely the responsibility of Lee as an independent contractor. <br /> <br />3. City shall provide Lee a current copy of the City’s zoning and subdivision regulations, <br />zoning and subdivision maps, comprehensive plan, and other regulations on <br />development within City. While working in the community, City shall make available <br />office space and a computer for use. <br /> <br />4. City, its officers, agents, and employees shall cooperate and assist Lee in the orderly <br />performance of services to be provided for herein. <br />
