MINUTT;S
CITY COUNCIL
JULY 23, 2008
Variance is justified, or if a Text Amendment might be the way to go. He
indicated that City staff can study the issue and report back to the Council.
Keis felt that the options were to either deny the Variance or table it for
further study. The City Attorney indicated that if the matter is tabled, a
60-day waiver would be necessary from the property owner.
Holm indicated that the building on his property is the maximum size
building that could be constructed on this lot. Given that he cannot
expand the building, he needs additional storage space. Holm pointed out
that each storage container provides 320 square feet of additional storage.
The City Planner indicated that the Council could approve the Conditional
Use Permit for four storage containers. The remaining four would be in
violation. The Planner suggested, however, that the Council could direct
staff to withhold enforcement until there is some resolution on either a
Variance for the trailers or a Text Amendment increasing the number
allowed.
It was the consensus of the Council that more study was needed on the
number or the percentage of storage trailers that would be allowed on a
property. The Council pointed out that the property owner would have to
sign a 60-day waiver to allow additional time to study the issue, or the
Variance request would be deemed denied. Dave Holm indicated that he
would sign the waiver.
Procedures relative to the CUP and Variance were discussed, and the City
Attorney indicated that the public hearing could be closed on both issues
with action taken on the CUP and tabled on the Variance for further study.
The Attorney noted that only the applicant is present on this matter, there
are no other individuals from the general public present this evening
wishing to comment.
There was no one else present from the general public wishing to
comment on this matter.
Upon motion by Keis, seconded by McGraw, the public hearing was
closed.
Mr. Blesener introduced the following resolution and moved its adoption:
RESOLUTION NO. 2008-7--177 -APPROVING THE CONDITIONAL
USE PERMIT ALLOWING OUTDOOR STORAGE OF STORAGE OF
UP TO FOUR (4) STORAGE CONTAINERS ON THE PROPERTYAT
53 WOODLYNAVENUE, ON-SITE AIR TEMP, SUBJECT TO
10
