An action to take over the Pitrina Park cul- <br />de-sacs would result in the same request from other townhome associations. <br />.Fahey felt the unfairness part of this issue may be that the developer did not <br />communicate the situation properly. <br />The City Administrator indicated that the Development Agreement refers to <br />public and private streets, and that the Development Agreement is binding on <br />heirs and assigns. The Administrator agreed that the issue comes down to <br />disclosure. He also agreed with the Mayors comments that there is no perfect <br />system to apply the services paid for through property taxes equally across all <br />properties. <br />John Miller, Pitrina Park resident, indicated that he was adequately informed of <br />the fact that the cul-de-sacs were private streets at the time he was purchasing <br />his property. Miller agreed, however, that the issue was one of fairness. <br />One property owner asked about the location of fire hydrants on the Pitrina <br />Park common property. The City Administrator pointed out that the City has <br />utility easements for the water and sewer lines in the area. <br />Helgeson asked that the Council take a few days and think about the issue and <br />the fairness of the situation. <br />Fahey again asked for a copy of the documents that were provided to <br />homeowners so that he could review them. Fahey stated that he is concerned <br />about the precedent that it would set in the City taking over these cul-de-sacs. <br />He pointed out that if this action is taken, the other townhome associations will <br />be malting the same request. <br />Ilelgeson stated that he appreciated the Council's consideration of the issue <br />and indicated he would get the Mayor a copy of the documents he requested. <br />Scalze asked for an updated breakdown of association dues. <br />Fahey stated that he would like the City Planner to determine what other cities <br />are doing with the issue of private versus public streets and if any cities are <br />taking private streets back and under what conditions. Fahey suggested that <br />the matter be discussed again at the July l 1'~' meeting. <br />The Council reviewed the request by St. John's School for removal of no <br />parking signs on McMenemy Street in front of the school until the <br />construction project at the school is completed. The City Administrator <br />recommended that the signs be removed and reinstalled upon completion <br />of the construction project gave the on-street path on McMenemy Street. <br />i.> <br />
