Ayes (5) LaValle, Scalze, Montour, Anderson, Fahey. Nays (0). Resolution declared adopted. PITRINA PARK Mayor Fahey noted the request of the Pitrina Park Townhome Association REQUEST TOR that the City take over the maintenance of private eul-de-sacs. Fahey CITY TO TAKE indicated that he has reviewed the association documents that were OVER PRIVATE provided to buyers. Fahey indicated that the documents cleat ly establish CUL,DE-SACS the ownership of the common areas including the cul-de-sacs and reference the duties of the townhome association relative to maintenance of these common areas including the cul-de-sacs and driveways. Fahey stated that he is satisfied that there was no misrepresentation or non-disclosure on the part of the sellers to the buyers. Fahey further noted the information obtained by City staff relative to policies that other cities may have adopted regarding the taking over of private streets. He noted that except where there are significant public safety concerns or where it can be shown that the streets and setback meet city standa~~ds, cities are not taking responsibility for maintaining private property. Fahey commented on the issue of fairness raised by the Pitrina Park Townhome Association and noted that fair does not always mean equal. Fahey pointed out that there are many property owners who pay for City services that they may not realize the benefit o£ For example, properties abutting County roads do not benefit from City tax dollars that are spent for plowing City streets. There are also large apartment complexes in the City with long driveways that must be maintained by the owners of the apartment complexes. Fahey suggested that if the City took over the maintenance of the private cul- de-sacs in Pitrina Pati<, other townhome associations and apartment complexes with private streets would make the same request. Fahey noted that Council's recent change in policy that resulted from the development of Park View Court townhome development, that townhome complexes will not longer be accepted with private streets. Montour noted that most cities do not have a standard policy for handling requests to take over private streets. Montour asked if that was something the Council wanted to consider adopting.
