MINUTES <br />C11'Y COUNCIL <br />OCTOBER 10, 2001 <br />too high. Morelan noted that the City can only assess the amount by which a <br />property benefits from the improvement. Morelan pointed out that both the <br />City and property owners could likely obtain appraisals that would support <br />varying benefits received, and either may or may not be held up by the courts. <br />He also noted the inequities of the fact that properties abutting County roads <br />are not assessed for road improvements, while properties abutting City roads <br />are assessed. <br />Gregor raised an issue about one property on Australian that was not provided <br />a concrete apron given that the driveway consists of Class V. Gregor felt that a <br />concrete apron would have prevented as much dirt from washing down the <br />driveway, into the street, and into the storm sewer system. He also felt that the <br />apron would provide for a more consistent look along the street. The Engineer <br />felt that putting an apron at the end of this dirt driveway would create a place <br />for water to sit and pond. Fahey pointed out that if the driveway is dirt, even a <br />concrete apron will not prevent dirt from eventually getting into the street. <br />Gregor indicated that at the neighborhood meeting the City indicated that the <br />first assessment payment would not be due until May, 2002. The City <br />Administrator indicated that for assessments certified to the County, the first <br />payment will be due May 15, 2002 along with property taxes. <br />Gregor asked about spreading the payments out longer than the 10 years <br />proposed. The City Administrator reported that the City's fiscal advisors have <br />looked at the issue of assessment terms and ] 0 years provides the best <br />economical return. <br />There was no one else presenting wishing to comment on this matter. <br />Upon motion by Fahey, seconded by LaValle, the public hearing was closed <br />Mr. LaValle introduced the following resolution acid moved its adoption: <br />RESOI.
