MINUTi15 <br />CITY COUNCIL <br />OCTOBER 10, 2001 <br />less than 5 feet ofright-of--way as the street abuts the Gregor property, the <br />street pavement lies entirely within the right-of--way. <br />Gregor also raised an objection to the assessment in that Australian Avenue is <br />considered a part of the City's trail system, which will have an impact on <br />whether or not on-street parking is allowed. Gregor felt that if on-street <br />parking is prohibited, the City should pick up a greater share of the street <br />improvement costs. <br />The Council discussed this issue and asked the City Administrator to research <br />whether or not on-street parking is prohibited on Lake Street. Lake Street is a <br />short section of roadway that is used for on street access to a neighborhood <br />park area, similar to the use of Australian Avenue for access to the Jackson <br />Street trail It was thought that both streets are approximately 28 feet in width. <br />The Council noted that before taking action on whether or not to post no <br />parking along Australian Avenue, it would look at what was done with Lake <br />Street. The City Administrator noted that a possibility might be to just post <br />one side of the street as no parking due to limited traffic volumes. The Council <br />did not feel, however, that the use of Australian Avenue as an on-street trail <br />was a basis for reducing assessments. <br />The Council instructed the City Engineer to work with Mr. Gregor on the issue <br />of his driveway apron to ensure that construction standards have been met, and <br />if the alignment of the apron is defective, that the City Engineer use his best <br />judgement in resolving the situation. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2001-10-220 -DENYING THE 013.IECTION TO <br />ASSESSMENT MADEBY.IIMGREGOR, 107AUSTRALIANAVENUE <br />BASED ON THE COUNCIL'S DLSCU.SSION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Anderson, Montour, Scalze. <br />Nays (0). Resolution declared adopted. <br />Steve Morelan, 109 Bluwood Avenue, pointed out that the two streets are very <br />similar in size, however, the costs of improving each are different. The <br />Engineer reported that Bluwood Avenue was more expensive given the need to <br />relocate fire hydrants, there was more clearing involved along this street, and <br />the cul-de-sac is larger in area. <br />Morelan indicated that the project was a good one and that the project manager <br />did a good job.
