MINUTES CITY COUNCIL OCTOBER 10, 2001 October 1 I'~' -Market Place Shopping Center, 3 p.m. to 7 p.m. October 12'x' -Hoggsbreath, 3 p.m. to 7 p.m. October 13'x' -Pioneer Park, 9 a.m. to 1 p.m. October 14°i -Fire Station, 9 a.m. to 1 p.m. The Chief also reported that donations can be mailed to the Little Canada Fire Department at 325 Little Canada Road. Checks can be made payable to the Little Canada Fire Department with the department in turn issuing one check to the New York Fire Fighters. VACATION - Mayor Fahey opened the Public Hearing to consider the vacation of the LAKE STREET Lake Street right-of--way from Rice Street on the west to Park Street RIGHT-OF-WAY on the east as petitioned for by Montanari Homes. There was no one from the general public present wishing to comment on this matter. Upon motion by LaValle, seconded by Fahey, the public hearing was closed The Council reviewed the Public Works Director's recommendation for retention of the appropriate easements to ensure that storm water can drain from existing ponds in the area to the Park Street storm sewer system. The City Administrator recommended that the vacation be contingent upon the retention of necessary easements. The Administrator indicated that it may be necessary to define the inlet to the storm sewer pipe to describe the easement. Mr. Fahey introduced the following resolution and moved its adoption: RESOI, UTION NO. 2001-I0-224 -VACATING THE I AKE STREET ROAD RIGHT-OF-WAY FROM RICE STREET TO PARK STREET CONTINGENT UPON THE RETENTION OF THE APPROPRIATE DRAINAGE AND PONDING EASEMENTS AS DETERMINED NECESSARY73Y CITY STAFF The foregoing resolution was duly seconded by LaValle. Ayes (5) Fahey, Scalze, LaValle, Montour, Anderson. Nays (0). Resolution declared adopted. REZONING - Mayor Fahey opened the continuation of Public Hearing to consider the 3203 COUNTRY request of Christ Community Church for rezoning of property located at DRIVE -CHRIST 3203 Country Drive from Business-Warehousing (B-W) to Public (P). COMMUNITY Fahey pointed out that since the last meeting staff met with representatives
