MINUTES <br />CITY COUNCIL <br />FEBRUARY 9, 2000 <br />negotiated with the City in the option agreement, he felt the terms should <br />stand as is. Fahey suggested that perhaps DeLonais-Adams was given bad <br />information early in the process about the value of the property and the <br />result is her feeling that the property is worth more than the $350,000 that <br />the appraisal resulted in. Fahey stated that he had confidence in the <br />process that the City Administrator and Mr. DeLonais went through in <br />drafting the option agreement, and indicated that he did not want to now <br />put the City at a disadvantage with regard to the purchase. <br />Morelan agreed with Fahey's comments and again commented on the <br />process that the City Administrator and Mr. DeLonais went through in <br />drafting the option agreement. Morelan indicated that if Mr. DeLonais <br />had wanted two or three appraisals before a purchase price was settled on, <br />then that would have been included in the original option agreement. <br />Fahey stated that the City has an agreement that is enforceable and there is <br />no evidence that the City acted in bad faith in this matter. Therefore, he <br />did not want to put the City at risk to have to pay more for the property <br />than what was agreed to. <br />Scalze agreed and pointed out that from what she knew of Mr. DeLonais, <br />he would not have entered into the option agreement without discussing it <br />with his daughter. Scalze commented that Mr. DeLonais worked hard on <br />the agreement and she felt the terms should stand. <br />The City Administrator pointed out that the City would like to work to <br />acquire the property in a mutually agreeable manner, however, there are <br />some time constraints that are coming into play. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RE.SOI.UTION NO. 20(IO-2-40 -DIRECTING THE CITYATTORNEY <br />AND THE CITYADMINISTRATOR TO PROCEED WITH THE <br />CLOSING ON THE DELONALS PROPERTY WITHIN THE <br />REQUIRED TIME FRAMES UNDER THE OPTIONAC,REEMENT <br />OTHERWL4E THE CITY SHOUT D COMMENCE ACTION FOR <br />SPECIFIC PERFORMANCE UNDER THE OPTION AGREEMENT <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (5) Fahey, Morelan, Pedersen, LaValle, Scalze. <br />Nays (0).
