MINUTES <br />CITY COUNCIL <br />FEBRUARY 9, 2000 <br />PREPARATION OF PLANS FOR THE IMPROVEMENT OF I,ITTI.E <br />CANADA ROAD FROM RICE STREET TO COUNTY ROAD C BY <br />ROAD RECONSTRUCTION, CONCRETE CURB ANI) GUTTER, <br />STORM DRAINAGE AND PONDIN(% STREETSCAPE AMENITIES, <br />BURYING OF OVERHEAD POWER LINES, UPGRADE OF <br />RAILROAD CROSSINGS, SANITARYSEWER REHABILITATION, <br />AND RIGHT-OF-WAYACQUISITIONAS DISCUSSED BY THE <br />CITY COUNCIL <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (5) LaValle, Fahey, Morelan, Pedersen, Scalze. <br />Nays (0). Resolution declared adopted. <br />RECESS At this point in the meeting, 8:45 p.m., Council took a short recess. The <br />meeting was reconvened at 8:55 p.m. <br />DELONAIS Mr. David Orenstein, attorney representing Kathy DeLonais-Adams, <br />OPTION appeared before the Council relative to the City's option agreement <br />AGREEMENT for the DeLonais property. Orenstein reviewed the fact that the City has <br />had an appraisal done of the property, the basis of which is the City's <br />purchase price. Orenstein indicated that in ordering the appraisal, the City <br />followed the letter of the option agreement and that Kathy DeLonais- <br />Adams approved the selection of the appraiser. Orenstein indicated that <br />while the letter of the contract was followed, he felt that sometimes doing <br />the right thing does not necessarily coincide. <br />Orenstein went onto outline the facts relative to DeLonais-Adams initial <br />valuation of the property for estate tax purposes, and her hiring of David <br />Massopust for a second appraisal. Massopust leas not completed his <br />appraisal, but preliminary estimates place the value of this property at <br />$6.00 per square foot or approximately $500,000. The City's appraisal is <br />$350,000. <br />Mr. Orenstein felt there was some evidence that the City's appraisal did <br />not generate fair market value for the property. Therefore, requested that <br />the Council agree that Kathy DeLonais-Adams would hire a third <br />appraiser that would be mutually agreeable to both the City's and her <br />appraiser, and whatever value is determined would be the purchase price <br />of the land. <br />Fahey indicated that he understands Mr. Orenstein's argument. However, <br />knowing Mr. Gene DeLonais and the fact that he was dedicated to the <br />City, wanted to see the City purchase his property under the terms he <br />12 <br />
