MINUTES <br />CITY COUNCIL <br />APRIL 12, 2000 <br />ability to request a hearing before the City Council. It was noted that <br />staff" s recommendation is relative to violations for sale of alcohol to <br />minors. Other violations could be dealt with under the existing <br />administrative procedure set forth in the ordinance. <br />The City Attorney pointed out that violations of tobacco and alcohol laws <br />that result in a citation being issued by the Sheriff's Department will be <br />prosecuted criminally. Under the tobacco regulations, administrative fines <br />are mandatory under State and Federal Law. Under alcohol regulations, <br />administrative fines are optional. <br />Fahey pointed out that tobacco violations are prosecuted and <br />administrative fines are imposed. Fahey felt that given administrative <br />fines are not mandatory under State and Federal Law for alcohol <br />violations, the City should not pursue them. He noted that there are still <br />criminal penalties imposed for alcohol violations. The Council concurred. <br />RUSH LINE The Council reviewed the staff report relative to the Rush Line Task <br />TASK FORCE Force update. The City AdminisU'ator reported that the City of White <br />UPDATE Bear Lake has joined in the joint powers agreement relative to the <br />planning for transportation improvements along the Rush Line corridor. <br />He noted that some concern has been expressed about the financial <br />responsibility that cities will incur if they join in the joint powers <br />agreement. The Administrator reported that the risk is minimal given that <br />there will have to be a unanimous vote by all participants to enact any <br />budget. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-4-92-APPROVING THE CITY'S <br />PARTICIPATION IN TILE RUSH LINE TASK FORCE JOINT <br />POWERS AGREEMENT IF IT APPEARS THAT THE PROJECT <br />WILL. MOVE FORWARD, AND AUTHORIZING THE MAYOR AND <br />CITYADMINISTRATOR TO EXECUTE THE .IOINT POWERS <br />AGREEMENT ON BEHALF OF THE CITY OF LITTLE CANADA <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Morelan, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />SOUTH OWASSO Mr. LaValle introduced the following resolution and moved its adoption: <br />TRAFFIC LIGHT/ <br />RIGHT TURN RESOLUTION NO. 2000-4-93 -APPROVINGlHEAGREEMENT <br />10 <br />
