MINUTES <br />CITY COUNCIL <br />APRIL 12, 2000 <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-4-83 -APPROVING THE ]SSUANCE OF <br />ONE 73UILDING PERMIT FOR THE PARK PLACE <br />DEVELOPMENT PRIOR TO THE RECORDING OF THE FINAL <br />PLAT SU73JECT TO APPROVAL OF THE DEVELOPMENT <br />AC,REEMENT 73Y THE CITY COUNCIL <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) LaValle, Pedersen, Fahey, Scalze, Morelan. <br />Nays (0). Resolution declared adopted. <br />CUP & Fahey opened the continuation of public hearing for consideration of a <br />VARIANCE Conditional Use Permit to allow a group home facility providing short- <br />FOR RESPITE term respite care as well as a Variance from setback requirements. The <br />HOME - group home is proposed on property at the southeast corner of Little <br />NORTHEAST Canada Road and McMenemy Road. The Planning Commission has <br />RESIDENCE recommended approval of the CUP and the Variance. Staff is <br /> recommending denial of the Variance given that the hardship requirements <br /> have not been met. <br />Fahey reported that since the March 22"`{ Council meeting at which this <br />proposal was last considered, the St. Paul Board of Water Commissioners <br />have been contacted to determine if they would be willing to sell property <br />to Northeast Residence to negate the need for a setback variance. The <br />Board of Water Commissioners has indicated a willingness to sell the <br />property needed by Northeast Residence. <br />Morelan asked if Northeast Residence was withdrawing their request for a <br />variance. <br />Corrine Schmit, Northeast Residence, reported that they will purchase the <br />property from the Water Department. She asked that they be allowed to <br />begin construction on the respite home prior to finalization of the sale of <br />the property so that there are no further delays in getting the facility under <br />construction. <br />The City Administrator recommended that the Council act on the CUP <br />request at this time and table action on the Variance pending finalization <br />of the sale with the Water Department. If the sale does not come to <br />fruition, then the Council can act on the Variance request. <br />
