MINUTES <br />CITY COUNCIL <br />APRIL 26, 2000 <br />HOME The Mayor opened the continuation of Public Hearing for consideration <br />OCCUPATION of a Special Use Permit to allow a home occupation consisting of a <br />PERMIT - satellite and antenna installatiot>/service/repair company at 2622 7ackson <br />2622 Street as requested by Scott Bixby. Fahey noted that the Planning <br />JACKSON - Commission has recommended approval of the SUP contingent on a one- <br />year limitation on the permit. <br />Morelan noted that Mr. Bixby informed the Planning Commission that he <br />is currently in the process of looking for property to relocate the business. <br />Morelan asked the status of that search. Mr. Bixby reported that he has <br />looked at several properties, but has not yet made a decision but felt that <br />the year limitation on the SUP would give him ample time to relocate the <br />business. <br />Scalze questioned granting a permit for the home occupation, and <br />suggested it would be better handled as a code enforcement issue with a <br />certain amount of time given for relocation. Scalze felt that granting a <br />permit for the home occupation would also grant some legal rights to the <br />property owner. <br />The City Planner pointed out that the issuance of a SUP would allow the <br />City to require clean up of the property and place conditions on the <br />operation of the business. However, there would not be a big difference in <br />the way the property is handled if the matter was dealt with as a code <br />enforcement item. <br />Morelan asked if the City had the ability to issue the SUP for a period less <br />than one year. The Planner replied that the Code says one year after <br />which the permit could be reissued in three-year increments. <br />Fahey pointed out that the business has been located at this property since <br />1980 and has grown substantially over the past 20 years. Fahey suggested <br />that the matter be treated as a code enforcement action and the applicant <br />given a specified period of time to relocate the business. Code <br />enforcement action would be withheld during that time period. Fahey <br />pointed out that the Bixby business is a commercial operation and not a <br />home occupation. <br />Pedersen agreed and felt that six months should be the most that the <br />business is allowed to remain at the property. Pedersen felt that this <br />business was clearly an inappropriate use of residential property and <br />should not be allowed to continue. <br />Morelan stated that he would be willing to issue a permit for six months <br />with no extensions subject to compliance with the recommendations of the <br />
