MINUTES
CITY COUNCIL
JUNE 27, 2000
Morelan pointed out that his concern was with requiring large setbacks for
properties abutting land that will never be developed. Morelan questioned
why the City would want to maintain a large setback in that circumstance.
Fahey suggested that perhaps the City Planner should report to the Council
on the issues of setbacks and what other cities do where land abuts
undcvelopable property. Fahey pointed out that setbacks are necessary to
ensure adequate space around buildings not only for emergency vehicle
access, but also for open space.
Scalze pointed out that the City cannot be assured that property such as the
Water Works property will always be open space. Properties such as this
could be used for recreational uses in the future which could have an
impact on adjacent properties.
The Council requested that the City Planner provide a written report on the
issue of setbacks for their further consideration.
GUERIN The City Attorney reported that in response to the City's settlement offer
LITIGATION of May 9, 2000, the Guerin Family made acounter-offer and have since
withdrawn that offer. Therefore, the City Attorney requested a closed
session to discuss the Guerin litigation.
Mr. Fahey introduced the following resolution and moved its adoption:
RESOL UTION NO. 2000-6-160 -CALLING FOR A CLOSED
SESSION TO DISCUSS THE GUERIN LITIGATION AS
REQUESTED BY THE CITYATTORNEY
The foregoing resolution was duly seconded by Morelan.
Ayes (4) Fahey, Morelan, Scalze, Pedersen.
Nays (0).
