MINUTES <br />CITY COUNCIL <br />AUGUST 23, 2000 <br />O'Neil again stated that the City will not stop her from utilizing her <br />property. She reported that she would be applying for a building permit. <br />Fahey indicated that a building permit would be granted if the appropriate <br />plans which meet City Codes are submitted in conjunction with the permit <br />application. <br />O'Neil indicated that she would cut down all the scrub trees on her <br />property and pointed out that this will change the appearance of the area <br />for her neighbors. O'Neil indicated that she will utilize her property, and <br />if the City will not allow her to do so, she will go to the Supreme Court. <br />Fahey suggested that the O'Neil's comply with the City's ordinances and <br />respect the property rights of their neighbors as well as themselves. <br />O'Neil replied that this is her property and she will do with it was she <br />wishes. <br />Scalze replied that O'Neil can do with her property as she wishes as along <br />as what is done complies with the City's codes. Fahey agreed that O'Neil <br />needed to stay within the law and the City's ordinances. <br />O'Neil pointed out that she has applied for a building permit to put an <br />addition onto the existing house. That permit has been denied since the <br />City is requiring a connection between the existing house and the addition. <br />O'Neil pointed out that she has contacted the State Historical Society <br />since this house was constructed in 1914, and she disagreed with the <br />City's requirement to cut into the existing house to connect the addition. <br />O'Neil stated that no matter which way she turns, the City is trying to stop <br />her. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Morelan, seconded by LaValle, the public hearing was <br />closed. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2000-8-194 -DENYING THE O'NEIL REQUEST <br />FOR A VARIANCE FROM THE REQUIREMENT FOR DIRECT <br />ACCESS TO A PU73LIC.STREET AI,I,OWING ACCESS FOR A LOT <br />LOCATED ONKELLER PARKWAY FOR A DRIVEWAYEASEMENT <br />TO LA730RE ROAD FOR THE PROPERTYAT 666 (640) LA730RE <br />ROAD BASED ON THE FINDINGS OF FACT THAT A HARDSHIP <br />12 <br />
