MINUTES <br />CITY COUNCIL <br />AUGUST 23, 2000 <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-8-190 -APPROVING A CONDITIONAL <br />USE PERMIT AL LOWING ANACCESSORY BUILDING FORWARD <br />OF THE REAR BUILDING LINE OF THE PRINCIPLE <br />STRUCTURE FOR 3179 SPRUCE STREET AS REQUESTED BY MR <br />DON VAI.ENTO SUBJECT TD COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Morelan, Pedersen, Fahey, Scalze, LaValle. <br />Nays (0). Resolution declared adopted. <br />CUP & Mayor Fahey opened the public hearing to consider applications for <br />VARIANCE - a Conditional Use Permit allowing total garage space of approximately <br />743 EAST 1,300 square feet, Conditional Use Permit allowing an accessory <br />COUNTY garage forward of the rear building line of the principle structure, and a <br />ROAD B-2 - Variance from the front yard setback requirement for an accessory <br />TACHENY garage as requested by Mr, and Mrs. Tacheny for property at 743 East <br /> County Road B-2. It was pointed out that the Planning Commission has <br /> recommended approval of these applications. <br />Mr. Dan Tacheny reported that he currently owns a business in Little <br />Canada and concern has been expressed that he will use the accessory <br />garage for business materials. Tacheny assured the Council that the <br />garage will be for his residential use and there will be no commercial use. <br />Kevin King, County Road B-2, indicated that he wanted to verify <br />comments made at the Planning Commission meeting about an existing <br />erosion problem on the hill going down to the lake. King supported Mr. <br />Tacheny's placement of the garage as proposed and felt that this <br />placement would reduce run-off down the hill. King presented the <br />Council with pictures of erosion problems that occurred in 1997. <br />Chris Nitardy, Alexander Homes, presented a survey of the Tacheny <br />property showing elevations as well as the existence of an oak tree behind <br />the house. Nitardy pointed out that placement of the house and accessory <br />garage are as proposed given the need to work around this oak tree, other <br />trees on the property, an existing well in front of the house, drainage and <br />erosion concerns. <br />Scalze suggested that the attached garage could be expanded to provide <br />the additional garage space. Tacheny indicated that they wanted to <br />eliminate as much asphalt in that particular location to minimize the <br />
