MINUTES <br />CITY COUNCIL <br />AUGUST 23, 2000 <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-8-193 - APPROVING A VARIANCE FROM <br />THE FRONT YARD SETBACK REQUIREMENT FOR AN <br />ACCESSORY GARAGE FOR 743 EAST COUNTY ROAD B-2 AS <br />REQUESTED BYMR AND MRS. TACHENYBASED ON THE <br />FINDINGS OF FACT AS OUTLINED BY THE PLANNING <br />COMMISSION <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (4) Morelan, Fahey, LaValle, Pedersen. <br />Nays (1) Scalze. Resolution declared adopted. <br />VARIANCE - Fahey opened the public hearing to consider the application for Variance <br />666 LaBORE from the requirement for direct access to a public street allowing access <br />ROAD - for a lot located on Keller Parkway via a driveway easement to LaBore <br />O'NEIL Road as requested by Mr. and Mrs. Theodore O'Neil for property located <br />at 666 LaBore Road. The Planning Commission has recommended denial <br />of the Variance. <br />Patricia O'Neil, property owner, appeared before the Council. She noted <br />that she has had the address for 666 LaBore Road changed to 640 LaBore <br />Road. O'Neil requested to read a letter to the Council relating to this <br />variance request. In that letter Mrs. O'Neil points out that their July <br />meeting, the Planning Commission had recommended that the O'Neil's <br />and the neighbors get together to see if a compromise could be worked out <br />to the various issues that were raised. The neighbors refused to meet on <br />the issue and had indicated that the O'Neil's will not get their variance. <br />Mrs. O'Neil questioned the neighbors dictating a decision on the variance <br />issue rather than the City Council. <br />Mrs. O'Neil reported that her husband has a prescription for a <br />handicapped accessible house, and the house they are proposing to build <br />would be handicapped accessible. She indicated that the grade of the lot is <br />11.8°/a, therefore, it would not be possible to construct the house with <br />access to Keller Parkway. As a result, they have requested a variance so <br />that access can come in from LaBore Road over the adjacent lot that they <br />own. <br />Mrs. O'Neil continued reading from her letter outlining her discussions <br />with representatives of groups, organizations, and government agencies on <br />the rights of the handicapped and the need for access to the proposed <br />
