MINUTES <br />CITY COUNCIL <br />SEPTEMBER 27, 2000 <br />VARIANCE - Fahey opened the public hearing to consider the application for Variance <br />2989 COUNTRY from the side yard setback requirement as well as Variances from the <br />DRIVE - building materials requirements of the I-P District for Suburban Auto <br />SUBURBAN located at 2989 Country Drive. The Planning Commission has <br />AUTO recommended approval of the Variances, while the City Planner is <br /> recommending denial. <br />Morelan asked if Dennis O'Connel, owner of Suburban Auto, planned to <br />stucco the entire building, both the new addition as well as the existing <br />structure. O'Connel replied that he did. The only portion of the building <br />that will not be stucco is the south side of the existing structure. <br />Scalze pointed out that originally this property was zoned Light-Industrial <br />and the property was developed with a metal building. After the building <br />was constructed, the City rezoned the property to Industrial-Park (I-P), and <br />the existing building became a legally non-conforming use. Scalze <br />pointed out that O'Connel has dramatically improved this building from <br />what it was, and the City should assist him by allowing him to finish the <br />stucco work on the building. <br />There was no one from the general public present wishing to comment on <br />this matter. <br />Upon motion by LaValle, seconded by Scalze, the public hearing was <br />closed. <br />The Council discussed findings of fact relative to the setback variance. It <br />was pointed out that the original building is located five feet from the <br />property line, and O'Connel is asking to continue that setback. It was also <br />noted that the Council has allowed variances from setback requirements to <br />continue existing setbacks on other properties in the City. The City <br />Planner pointed out the Planning Commission's discussion that moving <br />the addition in from the property line would block off an exterior door on <br />the building that is needed for functional purposes. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RE,SOL UTION NO. 2000-9-230 -APPROVING THE VARIANCE <br />FROM THE SIDE YARD SETBACK REQUIREMENT ALLOWING A <br />FIVE FOOT SET73ACK FROM THE SOUTH PROPERTYI.INE <br />BASED ON THE RECOMMENDATION OF THE PLANNING <br />COMMISSION AND BASED ON THE FACT THAT THE SET73ACK <br />WOULD CONFORM TO THE SET73ACK FOR THE EXISTING <br />I3UII.DINCAS WELI, AS THE FACT THAT THE CITYHAS <br />
