MINUTES <br />PLANNING COMMISSION <br />AUGUST 11, 2000 <br />King suggested that the lake side of these lots should not be considered the <br />back yard since you cannot do anything with this side of the lot given the <br />steep hill to the lake. <br />Tacheny pointed out that he owns the private drive. Therefore, his <br />property runs all the way to County Road B-2. The Planner indicated that <br />the driveway parcel is not wide enough to be considered frontage on <br />County Road B-2 for the purposes of building. <br />King asked the purpose of prohibiting accessory buildings from the front <br />yard. The City Planner replied that the reason is to create openness in <br />front yards, provide for emergency vehicle access to homes, and maintain <br />a minimum amount of setback from the street. <br />Tacheny pointed out that there is a water problem in the area of the lot that <br />the Planner is proposing that the accessory garage be constructed. Repairs <br />have been made to the hill where erosion has been occurring, and Tacheny <br />felt that there needed to be as much sod adjacent to the house and the hill <br />to correct the erosion. Placing the garage where the previous <br />garage/chicken coop existed keeps the run-off from the roof line away <br />from the hill. <br />Keis reported that he has looked at the property and there is a well in the <br />middle of the front yard area. Keis felt that an expansion of the attached <br />garage as suggested by the Planner would cause circulation problems <br />given this well location. Keis suggested that this, along with the location <br />of the property and drainage problems with the hill, were justifications for <br />granting the variance. <br />Knudsen asked about precedent in granting this variance. Barraclough <br />pointed out that there are not many properties in the City similar to this <br />one. He noted that it is located on a private drive, and the property owner <br />of the lot actually owns the private drive as well. <br />Montour asked what would stop Mr. King from making the same request. <br />It was noted the conditions unique to this property are the ownership of <br />the private drive, the location of the well, as well as the drainage/erosion <br />problem on the hill. <br />Keis recommended approval of the Conditional Use Permit allowing total <br />garage space of approximately 1,300 square feet as well as a Variance <br />from the front yard setback requirement for an accessory garage as well as <br />a Variance from the regulation prohibiting accessory buildings in the front <br />and side yards for 743 East County Road B-2 as requested by Dan and <br />
