MINUTES <br />PLANNING COMMISSION <br />AUGUST 11, 2000 <br />Wendy Tacheny for the following reasons and subject to the following <br />conditions: <br />* A hardship exists given the location of the existing well on <br />the property since relocation of the accessory garage would <br />cause circulation problems on the lot; <br />* Based on the fact that the location of the property itself is unique <br />and is accessed via a private drive; <br />*Based on the fact the private drive is owned by the applicant as a <br />separate parcel that, when added to the principle lot, the setback <br />would be 30 feet; <br />* Based on the fact that this is Lakeshore property and the back <br />yard of the property is unusable and an accessory garage could <br />not be constructed in the back yard of this property; <br />* A hardship exists given the existing erosion problems on the <br />hill to the lake and location of the accessory garage as proposed <br />by the Tacheny's would reduce run-off onto the hill area; <br />* Based on the fact that the location of the accessory garage will <br />have minimal impact on surrounding properties; <br />* Placing a future restriction on increasing the pitch of the roof <br />proposed for the accessory garage; <br />* Limiting the use of the accessory garage to personal use <br />only with no business use allowed; <br />* Conditioned that the Tacheny driveway encroachment onto <br />neighboring property be corrected. <br />Motion seconded by Carson. <br />Motion carried 5 - 1. Montour voted against. <br />VARIANCE - The Planning Commission considered the request for Variance from the <br />666 LABORS requirement for direct access to a public street allowing access for a lot <br />ROAD - located on Keller Parkway via a driveway easement to LaBore Road as <br />O'NEIL requested by Theodore and Patricia O'Neil for 666 LaBore Road. There <br />was no one present to represent the O'Neil's on this matter. <br />The City Planner reported that the last he heard was that the O'Neil's may <br />be abandoning their variance request. The Deputy Clerk reported that the <br />City has received no formal notification from the O'Neil's withdrawing <br />their Variance application. <br />Mr. Montour recommended denial of the Variance from the requirement <br />for direct access to a public street allowing a lot located on Keller <br />Parkway via a driveway easement to LaBore Road as requested by <br />
