MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 14, 2000 <br />Keis asked what the hardship would be to warrant granting the variance <br />for the extra curb cut. The Planner reported that the hardship has to be <br />based on the physical conditions of the property related to shape or <br />topography or any other conditions that would prevent the reasonable use <br />of the property. <br />Evans pointed out that due to the location of the building on the property <br />and the limited maneuverability on the site, a second driveway access is <br />needed on Spruce Street. Evans pointed out that it is difficult from the site <br />diagram to understand the maneuvering problems with the site. Evans <br />indicated that the issue is getting trucks in and out of the site. <br />Knudsen pointed out that the site already has two curb cuts on Ryan Lane <br />and one on Spruce. The applicant is asking for a fourth curb cut on <br />Spruce. Knudsen felt it was difficult to find a hardship to justify a fourth <br />curb cut for a property that already has three. <br />The City Administrator indicated that the building is very close to the <br />street; therefore, there are some physical constraints making <br />maneuverability on the site difficult. Barraclough pointed out that being <br />able to maneuver through the site is critical to the operation of the <br />business. <br />Duray asked if the City has allowed additional curb cuts on any other <br />properties in Ryan Industrial Park. <br />The City Administrator pointed out that currently the curb cut on Spruce <br />Street is one large open area. The City has asked that the property be <br />brought into conformance with the site plan that was approved in 1999 and <br />called for one 24-foot curb cut on Spruce Street. The applicant has <br />indicated that this will not work for their business. As a result, the <br />variance has been requested allowing an additional curb cut. The <br />Administrator pointed out that given the close proximity of the Public <br />Works Garage to the street, the City has allowed a large open curb cut for <br />that building. <br />Mr. Knudsen recommended approval of the Amendment to Conditional <br />Use Permit allowing the expansion of outdoor storage area for 182 Ryan <br />Lane as requested by Janis Evans and recommended approval of the <br />Variance allowing a second driveway access on Spruce Street as requested <br />based on the following criteria and subject to the recommendations of the <br />Code Enforcement Officer as outlined in his report dated September 14, <br />2000: <br />*The second driveway access on Spruce Street is needed to allow <br />
